I'm not advocating that he should be excused under the law, but it's a misdemeanor charge for forth degree assault for a reason. The law is the law. And the law implies a fourth degree assault is less bad than a third degree assault. And a third degree assault is less bad than second degree assault. And second degree assault is less bad than first degree assault. Fifth degree sexual assault is probably wanking in front people or being a Franky flasher or mooning people out the window of a vehicle. It's less bad than fourth degree.
So the idea of this going to trial seems absurd to me when he probably just plead out and apologize or do an online course.

When touching equals a criminal charge, the touching under any circumstances was obviously not a lapse in judgement. Adding extenuating circumstances on top of this - her age, apparently relationship to his daughter - makes it more alarming, as well as legally more serious, and unquestionably more repugnant.
There is NEVER a 'lapse of judgement' when sexual assault happens. I don't care at what degree. Being drunk doesn't excuse it.
I don't know if Kesler is guilty of this or not, and all we can do is hope that if he really did do this, the courts will find him guilty and he can enjoy living as a registered sex offender from now on, as he would deserve.
I find it rather disgusting that someone would be playing devil's advocate here - not for the sake of innocent vs guilty, but rather heinous act vs lapse of judgement. That's an absolutely disgusting take on things.
