NHLPA will make that very hard to do, if not impossible, since he still has a valid contract.
He has NMC but what exactly does that mean? Most NMCs allow the team to submit a list of teams he can be traded to. CapFriendly doesn't list the stipulations on his NMC. Can't surely be a complete NMC, can it?

The year the Hawks got Toews they had 65 points. The year they got Kane, the won the lottery and moved up to 1st. They had 71 points that year.
I believe that the Flames are probably a 70-point team after the deadline. We trade Markstrom, probably a bottom 5 team. Stay there until you get a couple top 3 picks for sure. Summer will tell if they don't think that is a good plan.
I posted a reply earlier, 3rd last in the NHL in the last 19 years averages 69 points. We are pretty close to that.

NMC's mean that the player cannot be traded to any of the 31 other teams without the players consent and cannot be sent to the minors without the players consent. There are no exceptions in a NMC.

Some players have NMC with modified NTC’s. Can’t be moved down; but can be traded to a list of teams. How does the NHLPA have any say in benching a player?

Yeah but that doesn't address their biggest issues which are blueline and goaltending. Marner is interesting as he's definitely a great player in the regular season but he's certainly not the missing piece for a cup contending team because he's purely a complementary winger and his price will be prohibitive. He's going to be more valuable to teams like the Kraken or Salt Lake city that are starved for star talent.

They can just apply pressure internally and externally. The Leafs would obviously be benching/scratching Marner out of retaliation for not agreeing to waive.
I don't think they'd do it to make a point though, tough to make the playoffs when you have a ppg player sitting and having 11 million in dead cap.

He has a valid contract, he is healthy and he wants to play.
The team wants to sit him because he won't accept a trade won't sit well with the NHLPA.
I faintly recall there being precedent to a similar scenario but I can't recall the team or player.

Realistically, it isn’t something a team is going to do if a player can produce. Because that wouldn’t make sense. But, healthy scratches are a thing… it sounds insane to me that the NHLPA could pipe up about a teams lineup. I don’t understand what grounds they would even have.

Toronto benching Marner to force a trade would likely the dumbest thing a team has ever done.
Helps Toronto lose. Creates real issues with its current players and potential other players who might one time look to play for Toronto.
Marner can sit and watch Toronto panic, hurts them quite a bit more.
