Sounds like Cosby agreed to talk if he would not be charged criminally, any testimony would be used in a potential civil suit. If true then the judge got this one right, but why Cosby was given such a deal in the first place is unconscionable.

I think Castor gave him the deal originally which is why he is free now. Steele was the one that actually prosecuted him.

Castor gave him the deal originally for the deposition.
Over a decade later the deposition lead to his arrest, conviction and three years in jail.
Ergo, I believe it's just as fair to say that Castor lead to his three years in jail.
Without the immunity, Cosby doesn't speak. Future prosecutors have nothing. No charges, no trial, no jail.

Right, but if you make the promise that you can't use any of the testimony to indict him, what difference does it make? Why bother getting the testimony if you can't use it?

It was for the future civil case. At least that's what Castor has said and it does seem to make some sense on the surface but I'm not sure that's how I would want a DA to operate. But very arguably it resulted in a settlement for the victim (of 3.5M). Hardly justice, but better than nothing...maybe.

I can’t figure out how a verbal deal is even enforceable.
The Statute of Frauds generally requires contracts having a term of one year or longer to be in writing.
Guess Cosby’s attorneys argued that some exception to the SOF (there are a few) applied?

I think if a person is compelled to testify by way of promising non-prosecution in a scenario they would not otherwise testify willingly, it doesn't matter if it was written down or not, to then prosecute them after they spill the beans is a violation of their 5th Amendment right. There were likely enough people with the knowledge of what went on to corroborate it.
