Brandon Vezmar, 37, said the woman walked out of the screening of Guardians of the Galaxy, Vol. 2 when he complained about her persistent phone use.
Mr Vezmar filed the petition in the state capital of Austin last week seeking $17.31 (£13.30), arguing his date's behaviour was "a threat to civilised society".
She said she refused to reimburse him because "he took me out on a date".

You know, its not always the guys fault right.

Texting away during a date is incredibly rude, if there's no chemistry tell him and cut things short, you know look him in the eyes and say, this isn't working good night.

Texting on an outing in a theatre is pretty boorish behavior, especially on a date, basically she deserves a hearty get lost.

GIRL: *oh god this guy is weird af...still want to watch this movie though...guess I'll soldier through because he might publicly freak out if I try to leave since I drove him here...better text Stacy and make sure she's still available if I have to go*

WEIRD GUY: "UH I'M TRYING TO ENJOY THIS MARVEL FILM HERE. CAN YOU PUT YOUR PHONE AWAY NOW?"

GIRL: "Yeah like, give me a second"

WEIRD GUY: "OH MY GOD. WOMEN NOWADAYS ARE SO OBSESSED WITH THEIR PHONES. LOOK FOR MAKEUP TIPS LATER."

Yeah you guys are right, texting during a movie is definitely on-par with suing someone for texting in a movie and claiming they are a "threat to civilized society" after they drove you to said movie.

"I had my phone low and wasn't bothering anybody" is a lame excuse and isn't true. She was wrong to be texting in the movie, end of discussion.

The guy was well within his right to call her out on it and ask her to step outside to do it. Her disappearing without saying anything is rude.

Him asking her to reimburse him for the ticket after walking out on him, is fine if not a little odd since most people would have just cut bait then. Him suing her after the fact is ridiculous.

TLDR - Both of them are losers.

Pretty big reach that the guy was (quite obviously) a creepy weirdo. Not sure why you have such a need to defend her so vigorously when she was being rude and selfish. If she needed to text so urgently she could have done so outside the theater.

The lawsuit is ridiculous. Beyond ridiculous.

But amusing that you are ok with calling the guy out as an obvious creepy weirdo to justify her behaviour. Heaven forbid we just all recognize that texting/using a phone in a theater is bad manners and filing a lawsuit over it even more insane. Keep fighting the good fight.

You are making quite the assumption that; a) he was a creep (I know he's an idiot but there's no indication that he' a creep) and b) that she was texting as a bug-out excuse as maybe she simply is one of those people that can't stay off their phones?
