How often does this happen.

I would assume that only heinous or high profile cases would be targeted, but that being said, I can't recall hearing of this being done (I will admit I don't follow this type of news exceptionally close).

I like the idea in the English Courts that they (and I think they don't do it anymore) but sentence you to the Queens pleasure, which is an indefinite sentence. you'll get out but you'll be old and you won't be a threat.

These two are a threat to re-offend by the sounds of it, tag them with dangerous offenders tags and don't let them out until they are no possible threat.

I noticed that currently the "top story" on cbc's news page was surrounding the killing of a George Many Shots roughly a decade ago in Lethbridge. There is a picture of him with three children, and two of which appear to be male. Also, I noticed that Corey and Cody both have the middle name of George. Are these parties related? I was assuming they were until dad was shown coming from the courts. Thanks for any clarification.

Straight credit for time served in custody would be fine. But adding extra credit because serving time in custody is hard seems a bit much.

So if theyre not responsible, then we shouldt punish them and release them back into society? Liberal justice. These guys will re-offend when they are let out on the streets.

Anyone knows what would happen if the are found to have FAS and it made them not responsible? Would they go to a mental health facility? Can it be treated like other mental illness?

There is no way even in Canada they can let animals like this out Scott free, right? Not after what they did. That poor victim, I hope they nail these two in the end but in Canada I doubt it.

I would hope they receive the same treatment as Vincent Li. Receive
Treatment in a secure facility until experts agree they are not a risk to reoffend. It might be longer than a typical prison sentence

Vincent Li had one psychotic episode. These two have a string of crimes a mile wide and this one in particular was particularly revolting and terrifying.

I think public safety is king in this case, and part of me thinks that the only way they get out is if they're 90 years old and in wheelchairs.

it costs $11k to determine if somebody has FAS?

Or is that 5,500 each? Either way, seems excessive albeit I have no idea about what specialized tests they do I guess.

Not sure exactly but the analogy I've heard with FASD is that for most serious crimes it is hard to prove the defendant had no idea what they were doing was illegal. Like it is reasonable to assume someone with a low IQ and tendencies toward impulsive behavior might understand that throwing a rock through a window might damage the window and that is a bad thing. But it might not be so reasonable to assume they would know that the rock could harm or kill someone inside the house.

In this case I can't image FASD would prevent someone from understanding it's harmful to do wat they did. In Li's case he had no way of knowing reality. I don't think the same disconnect exists here, especially because there is no issue of consent.

I think that is actually GGG's point. There really isn't a way to treat FAS, so they would end up locked up there for all of eternity.

Treating adult FAS would roughly be akin to treating someone with Downs syndrome.

Simple, don't do anything that can cause you to stay in jail until a trial!!!! Extra credit for time in remand is BS.

No one likes remand that I've worked with but theyd all take 6 months on remand and 6 months in provincial over 18 months in provincial, and of course the lawyers make out like bandits with all the extra court time.

MRI plus lengthy questionnaire of family. The MRI is probably the expensive part.

What's the difference? I know the conceptual difference, but it sounds like the conditions are somehow much worse in remand. Just wondering how and why it's so different. Sorry for any derail.

Remand generally has no program time, the prisoners are all in for varying time spans, most only a couple of weeks or months but a few for a year or more therefore there's no way to provide education or skills programs, remand centres tend to be over crowded and so the prisoners get moved around a lot, to some degree it's just a state of mind, you're hopeful you'll get off but you probably won't so there's no certainty in life, it's a parking lot for a bunch of guys who are all stressed out, not sure what's going to happen to them.
