You better make sure your girlfriend isn't trolling you first. That's the most likely situation here (without knowing your gf obviously).

What? So someone externally is going to email HR? Is this common?

Nope. I guess she should file an anonymous complaint. I just worry about doing anything to upset the balance with this job market.

They aren't going to fire her for filing a complaint about a policy implemented that likely wasn't signed off on by HR.

It's not even a company wide policy.

Unreal. I certainly wouldn't be worried about her getting fired, that's pretty much the dumbest thing I've ever heard. I mean, aside from #1&2, what if she's on her period and need to take care of business? Would her manager have a problem with that? Like others have said, I would completely ignore it and absolutely file a complaint with HR.

Not only that but it might be a human rights complaint as well.

I would use the bathroom anyway- good luck firing me for using the bathroom, regardless of the economic situation in town.

As per the OH&S Code from 2009 (I think this is the most recent, it is the one I have that I bought in October)

Part 24 (Toilets and Washing Facilities)
section 354 (Restrictions by employer) reads

Quote:
An employer must not place unreasonable restrictions on a workers use of, or access to, any of the facilities required by this Part
Also under Toilet Facilities, 357(5)

Quote:
An employer must ensure that a toilet facility is accessible to the workers who may use it

I actually think getting it in writing is a gold move. Should pretty much kill the thing right there, so sane person would put that in writing...if they do, even better.

I'm telling her to go to the washroom and have her phone recording the exchange in her pocket cause it was verbal.

Being sneaky about it seems like bad idea. Just have her outright ask the manager to document the new rule in writing. If he does, bring it to HR. If he doesn't, then it's bull####.

Secret recording could easily be misinterpreted, that's not my voice etc.

If you wanted to prove for sure, personally, I would suggest an email asking a question black and white (in a seemingly innocent manner) requesting a yes or no answer to acknowledge if the rule is real.

Is the policy written down anywhere? I'd try to nap that, save the email, whatever to have it archived for myself. It would be a fun story for the local news.

Plus you only need 1 party consent to record someone. I've spoken with the police about this matter and they said it is perfectly legal to records someones voice without their consent.
