I don't think it should matter. Take your breaks when you want. If they fire you over it common sense would say a lawsuit would go in your favour.
But there's not a lot of common sense built into law sometimes.

Ahh finally was able to get a reply from my GF and apparently it's her manager doing it to her department only. Funny thing is her manager smokes.

I am guessing someone is really exploiting the bathroom break loophole and the company is doing a really badly worded and a misinformed/misguided policy to increase productivity has been implemented. I have heard of individuals who go into a stall to sleep (gross, I know) or individuals going to "powder up" in the bathroom ever hour or so (literal or metaphorical, not sure).
If she has to go, then she has to go. If someone confronts her, tell her to tell whoever is being a jackass that she has already accounted for removing said break from her lunch and that by arguing, they both are wasting more time than said bathroom usage. If she gets fired over it, then let the media have a field day. This assuming she legitimately has to go to the bathroom and isn't running inside for a phone call.
EDIT: Yes, complain to HR. Get that stupid idea documented.

If it's a single department via one manager, it's pretty obvious who the possible candidates of a complaint are...
EDIT: Any of this in writing? Maybe ask your GF to send an email like, "Hey, heard of the new bathroom break policy where we're only allowed to go at lunch. Is this correct? Don't want to make a mistake. Thanks". Kind of thing you can use as evidence later?
