I'm not familiar with the Kobe incident but that seems like it would be a relevant fact of the case.

I don't know if you are being serious here or not. But if you are falsely accused of a crime being extremely wealthy versus being poor has a massive effect on the chances of you being sent to prison.

Wrong as laid out in some other posts, she wore underwear the day after to her rape exam that had another mans errr goo and pubs in it. That put the credibility of the rape exam in question because of the possibility of contamination, that wasn't an attack on her prior sexual habits but of the possibility of contamination of the rape exam.
Also when they did the Rape exam on her they did find vaginal tearing, which the defense team tried to point out would have been consistant with her having sex with two men in consecutive days. Which could be a logical conclusion because she showed up with evidence of two men due to the dirty ginch. This wasn't an attack on her prior sexual history but of the physical evidence in hand.
Basically under the rape shield law the lawyers can no longer go after prior sexual history or hearsay of prior sexual history.
You can't make a link that a girl was promiscuous or went home with lots of other guys with the rape in question, a judge is obligated under rape shield to stop that line of questioning.
Prior behaviors are not current behaviors.
In a jury trial the judge will basically instruct the jury to disregard any discussion on past behaviors.
So the whole "She's a slut so chances are she wasn't raped" is an invalid argument now in the U.S. and I believe that Canada also has the rape shield as well.

Rape shield laws protect the accuser from being attacked for previous sexual history. Not so sure about accusations of gold digging by defence lawyers.
But when I talk about being trashed, it's mainly about media, fans, and now on the internet.
I do agree that a charge is getting less and less likely. As for Kane's future treatment, assuming that's the case, I agree with those who say negative treatment will pass. I think Kane can even get cabs when he wants now.

He was typing the way he talks, it's not that weird when you think about it that way. It sounds far more awkward on an internet message board than it would in a casual small group setting. I have heard plenty of people use the "It must be nice..." line in real life when ranting about criminals and I didn't think they actually want to "do it". I'm sure I've even said "It must be nice to be a murderer in Canada and know you're only getting a slap on the wrist when you get caught!" or something similar. It doesn't mean I want to be a murderer or think it would be nice to be one because the potential punishment is lax. It means I'm frustrated that murderers don't get punished harshly enough but I have used sarcasm to help make that point, which is a hard thing to do online where there is no context aside from words on a screen.

I'm sure if they are going to make a gold digger accusation there will be some evidence to go along with it. If not oh well is that the end of the world? If the negative treatment for Kane will pass wouldn't the same pass even quicker for the accuser? If media, fans and the internet are your concern I'm sure you understand how quickly they all move on to the next story. It's not an ideal situation but this idea that the woman will face such terrible treatment is just overblown in my eyes. Ya I'm sure there are a few idiots out there who will act like it towards both of them but for the large majority I don't think people will really care. And those that do care will likely forget pretty fast. I honestly couldn't tell you the name or face of any high profile rape accusers. People focus on the celebrity way more than the accuser. Sure while its directly going on people care a bit more but as soon as its over I think the vast majority of people move on.

Unless you are a complete and utter moron, it is practically impossible for a wealthy white man to be successfully prosecuted for sexual assault in the US.
All Kane has to do is throw money at it, and the problem will go away.
For example, a classic trick of defence lawyers is to invite the victim (who will usually be poor) to a settlement conference on the pretext of offering a lot of money in exchange for silence, withdraw the offer and then leak that there was a settlement conference to the press - in the hope of tainting the grand jury or jury with the "gold digger" slander.
It's a tactic as old as the hills, and seems to have worked here.
