Wow...this and confederate flags being taken down pretty much within a week. Great work USA! I'm impressed common sense is starting to prevail down there.

Yes, he's referring to the Supreme Court, in his opinion, now being the ruler of the land. Not that he had any problem with that in the Citizens United decision.

Yeah, you're misreading him - his dissent is about this issue being solved through the democratic process. In other words, the people should rule themselves rather than having their power to decide taken away from them by the Court. Has nothing to do with God.

I take his point, but on matters of fundamental human rights, you just can't put that sort of thing to a vote.

Are you under the impression that he'd be able to do anything about it as President? A President cannot somehow cancel a Supreme Court judgment.

The best he could do would be to nominate a super-conservative judge for SC associate justice (which would mean one of the nine died with him in office), then see that person confirmed by the legislative branch (over which he has no direct control). So he'd be expecting legislators to confirm a nominee in spite of over 60% of public opinion militating against that decision (as of today - the trend suggests that it'll keep going up). Thereby committing likely political suicide, in the vast majority of cases.

Then, someone would have to bring a case that would allow for this ruling to be overturned - which will be difficult given that there will be no gay marriage bans to challenge, but I suppose Alabama could pass such a bill solely for the purpose of having a legal fight about it.

Then, he'd have to convince four other judges to join him in overturning this decision. Which will be more or less difficult depending on who is on the bench. Remember that although there are four dissenters here, judges often dissent not because they wish the RESULT had been different, but as an opportunity to warn lower court judges relying on the judgment of what its limits should be.

Because it's worth pointing out how insane these people are. And that there are a lot of them out there. It doesn't take much to look. That's my biggest concern here is that the insane Christians of America will band together for the next election and put Ted Cruz or Mike Huckabee in office, and then God is running America. They can absolutely win an election if they can get the crazies to the polls.

You say that like it's not already the case.

Until a Presidential candidate can openly say "I don't believe in God" and still hold a shot in hell at winning, this will be the case.

So procedural question, because I'm unsure of how the courts work. But even with the supreme court ruling, can't the States individual argue that this should be a State regulated issue and fight it individually in their own State supreme court by asking for a States ruling on whether this is something that should be decided federally or by the State.

I'm just trying to understand how this is going to work or if this is the end.

Oh and HockeyIlliterate.

Lumping in homosexually with pedophiles and Polygamists who also tend to take on vulnerable childbrides borders on 50's thinking and is just really wrong.

Man, politics in the States is whack. At least here when we debate left vs right it's usually based on economic policies that have nuance and good arguments can be made for both sides.

Elections in the US seem to always come down to stupid social wedge issues that should be obvious like allowing gay marriage and not letting people buy assualt weapons that can be shipped to their house. If you had any kind of progressive social conscience you would really have to believe in the GOP's economic platforms and plug your nose when voting for them, goddamn.

Also Huckabee is a gigantic dumbass.

The answer is no. The time to make that argument was before the Supreme Court. The Supreme Court has ruled, its ruling is now the law of the United States.

Any such attempt would be illegal. Arguably treasonous? Less sure of the latter.

There really aren't though, and the only reason it seems like there are is because they yell bat#### crazy things and people repeat it and post it and write news articles about it.

There are a large number of Americans who don't agree that gay marriage should be legalized. There is almost no one who thinks it's anything but disgusting to compare this to 9/11.
