Freedom of speech has to be regulated by the truth, you want to lie about someone that isn't speech it's libel, rumours ain't truth.

Freedom of speech protects our rights to express our ideas and opinions but doesn't provide protection against spreading misinformation against individuals in what is known as the harm principle.

To be clear, I don't think the original tweet is that big of a deal. It was stupid, but if TSN didn't show it on TV this conversation wouldn't be happening.

Reminds me of people who do something real annoying and say "it's a free country, I can do what I want!!!!" when someone asks them to stop.

Makes them look pretty petty going after a single tweeter. IMO TSN is the responsible party as they broadcast the tweet which would have been seen by maybe 10 people otherwise. Good luck getting cash Dion/Cuthbert/Lupul as TSN immedietly issued an apology. The question is: Does this legal action cause other NHL teams around the league to view Dion and Lupol as 'blacklisted'?

The tweeter sent it specifically to get on the, so the onus is on the tweeter. TSN simply failed to filter

Yes that's exactly what he is going to do with the money, go after "damages" because he lost his dignity. Toronto media has already stripped him of that long before this. I don't think the tweet should have ever made it onto to tsn but why bother with this kind of crap.

Why would they be 'blacklisted'? GMs don't like players that don't like to be on TMZ?

Someones head is going to roll on this one. Probably some lower level guy but none the less. Makes a mockery of TSN to act like that.

Where did the rumor come from anyway? Any basis in reality?

I think you over estimate the mitigating value of an apology from a media organization, if you or I, or say the original tweeter, says sorry quickly, then our relative inexperience will be taken into account, but TSN is supposed to both know better, have the resources and skills to prevent this and also will have caused far greater damage, sorry won't get them off the hook.

German born hockey player needed a nickname on draft day and this is what some doofus came up with on twitter. A term used by the Nazi's for the Jewish genocide. Utterly tasteless and made it to T.V. Yet, that is acceptable humor on the internet. I didn't like it as the kid had nothing to do with the past other than being born in Germany. It's just insulting on too many different levels.
