A system like JIRA is pretty good. Use it at work for all sorts of issue tracking or feature requests. Also allows for "voting", so if people are putting in moronic feature requests, they are weeded out.

Absolutely no coffee in my house this morning. None. I was not impressed.
And then WRGMG is when the aforementioned guy in the previous posts calls me this morning and tells me to open the door because he's outside my house without an excuse for falling off the map for 5 days. Seriously!?!?!?

Yeah...this happens to me as well. I just stop them and say "email me please so I have a record of it."

Go over, hand him money, leave, book a truck, come back, pick up items? Seems like a waste of a trip.

No. But I made him go get me some before I let him in the house and then told him he can find a new gf if he thinks its okay to drop off the face of the earth and then reappear when he wants to without an explanation.

So there was actually no explanation? What did he say when you asked for one?

I was too lazy to read back in the thread and thought vegasbound was talking about the guy who got his hot water shut off haha. Maybe he's disappeared too.

Now, it's not worth doing anything about that, because my damages are minimal. However, I could technically sue him. People are really casual with contracting on Kijiji; I was very close to sending a statement of claim to the movers I booked who didn't show up just to make the point that you can't conduct yourself like that without consequences.
Exactly. In this case it wasn't that bad, I just called the moving guys and told them I had to cancel. But what if I'd rented a u-haul or something? I'd be out the cost of the rental. I'd moved a bunch of stuff in preparation for having those things into my living room, and I just had knee surgery a couple of weeks ago so moving things around is not easy. So it was directly inconvenient.
More than that, though, it's just an ####### thing to do. A deal is a deal. If you don't want to commit to a deal, say so - i.e., "first person to put cash in my hand gets it". I've done that before, if you're up front about your terms it's fine. Just don't go back on your word.
|
That's not legally binding. A phone call telling him you're gonna buy it? That's no more legally binding than you telling him you're going to buy it, then you show up, and you see that it's broken and not worth the agreed price, and therefore, you're no longer interested. He can't sue you for that, and you can't sue him for not holding an item for you.
A contract isn't a contract until consideration has been exchanged.
Lol. You think you can sue him for this?

That sounds like a commitment to buy, but not an actual purchase. Not only should you have gone over to give him the money, but also to look at the damn stuff too. How was this going to go down? Delivery company picks up stuff, delivers it to your house. Upon satisfactory inspection, you would EFT the money to him? At what point was this guy going to get his money or have the purchase completed?
Don't blame the guy one bit. When buying ANYTHING used and it's a good deal, you buy it immediately on the spot or risk someone else swooping in and taking it. Buying is not asking someone to put it on hold. Deposits don't do crap either. Until enough money has transferred hands to cover 100% of that purchase price, I'd be worried about losing either my partial payment and/or the item I want. Hell, I have even had people return the full purchase price that I gave in advance because I couldn't pick it up within 2 days, but someone else could. Have you not purchased anything used before? Always go by "First come first served, as-is where-is"
Binding contract? LOL, good luck suing the guy. You have ZERO damages, nothing out of pocket unless you paid a deposit for the delivery guys.

If I show up with a bottle of wine and some flowers, would you let me in?
Seriously, saying he was busy doesn't cut it. Glad to hear you kicked his self centered ass to the curb.

Legal nonsense aside, that's still no excuse to be a jackass. You agree to sell something to someone, you don't go and sell it to someone else instead. Yeah, that's life, whatever. It's still wrong, and anyone that does it is a dick.
