While I appreciate the legal lesson:

1) I'm not sure there was a true meeting of the minds if he thought it was fine to sell to someone else before you got there;

2) you wouldn't have any damages; and

3) there was no exchange of consideration.

I'm not saying it isn't a dick move, but from the buying/selling I've done on Kijiji in the past, you are just going to be frustrated if you expect people to conduct themselves with honour. It certainly happens sometimes, but you'll be better off if you expect people to no-show and to sell it to whoever shows up first with cash in hand.

Anyways, I'll add my gear grinder. I'm in the process of buying a new vehicle, have it narrowed down to either a Ford Explorer Limited or a Toyota Highlander XLE. I'm planning on booking 1-2hr test drives with each of them then demanding invoice+$500 from whichever one I like best. Once (s)he turns down that offer, I'm going to email around to every dealership in Southern Alberta until I find one that will give me the best deal. Then I'm going to go to my closest dealer and ask them to match it.

What GMG is that doing all of this makes me feel like a jerk.
I feel like I'm wasting the salesperson's time, as well as all of the time of the other people responding to my e-mail.

What really GMG however, is that this is a system that the dealers have created for themselves. I have nothing against the salespeople at all, I get that they are doing their job. But if I can save $2000 by pissing off a dozen of them and haggling over e-mail, I'm sure as heck going to do it.

It' a finicky thing sometimes. For items that are time-sensitive, like tickets, it's more of a whoever brings the cash first gets the items.

However, it's not the wild west; if somebody emailed that they would like the tickets, and then somebody else emailed right after and says they can be right over, I would just respond back to the first person and offer them the option of coming to get them right away or passing on them, or at least verifying that they are really interested and not playing the field looking for better/cheaper tickets.

Exactly. In this case it wasn't that bad, I just called the moving guys and told them I had to cancel. But what if I'd rented a u-haul or something? I'd be out the cost of the rental. I'd moved a bunch of stuff in preparation for having those things into my living room, and I just had knee surgery a couple of weeks ago so moving things around is not easy. So it was directly inconvenient.

More than that, though, it's just an ####### thing to do. A deal is a deal. If you don't want to commit to a deal, say so - i.e., "first person to put cash in my hand gets it". I've done that before, if you're up front about your terms it's fine. Just don't go back on your word.
I think this is all on you, dude. If you wanted to secure the items, you should have showed up there with the cash and a truck. The guy was a bit remiss in not telling you the items are his to do with as he pleases until they belong to you, but as a buyer I assume that. When I want something off Kijiji I make sure to lock the guy down like that minute and I'll drop what I'm doing to meet him. First guy with the cash takes it. If you adopt my approach, you'll never ever ever ever have this problem again.

Okay so this is all wrong.
1. There is a meeting of the minds if you have certainty of terms as to the key conditions of the deal - i.e., we both know what he's selling me (the cabinets), we both know what I'm paying for them ($250), we both know the delivery date (today) and we both know the delivery method (I pick up). He didn't "think he could sell to someone else" any more than anyone else who enters into a contract for a prospective sale and undertakes efficient breach. This isn't an uncommon commercial practice, but it absolutely results in people getting sued.
2. I do have damages, in the sense that if I go out and now pay, say, $700 for a comparable set of cabinets, I'm out $450. This might be precisely what happens - the only other set I've seen lately that will fit the space I want to put them in is $700. My damages are the amount it takes to put me in the position I would've been in had the contract been performed. They're just not very much in this case.
3. What are you talking about? The consideration is property for money. It's the most basic consideration imaginable.

This is fine if this is how you want to conduct your sale but you have to communicate these terms up front. You don't arrange everything, have someone rely on your word (and set up a time and place on his terms, by the way - if not for the fact that he told me that the earliest he could do this was Thursday after 5:30pm, I would have had them picked up before he ever had the chance to sell them out from under me), and then back out.

I think the jerk move is going back to the original dealer with the quote. They all have the same numbers so I think you have to tell them that you don't like the price they are offering you will check other dealers. If one of them is cheaper you will buy from them instead.
Stringing the other dealers along with no thought of ever buying from them is a jerk move in my mind.

lol...and dealers never screw people over at all. As a guy who has bent over a couple of times for dealers, I agree with this person. As a buyer, I don't "owe" the dealers anything. They certainly couldn't give a crap about me. With almost every dealer I have dealt with I have been simply tossed aside after the "deal" is done and I know they are making quite a bit off of me. Sick of car salespeople and dealers.

Nope...have my coffee. Bitter? Maybe...just dealing with stupid people on a daily basis and sick of people who are dicks. Seems there are a lot of them out there and I seem to find them quite easily. I wouldn't really say bitter, more cynical or perhaps realistic.

This is a GMG's thread isn't it? Not, let's hug kittens and puppies thread right?

You know where McKnight turns into John Laurie as you head west? It has that dual turn there and almost every friggin day, some low functioning moron goes from the inside turn lane to the outside turn lane without looking, signaling or giving any indication at all of the massively stupid move they just did. Happened again yesterday - lady almost sideswipes the guy next to her. If he hadn't been quick on the brake, she'd have hit him. I pulled up beside her and kindly mouthed "what the #### are you doing?!". It was apparent she had no idea what the problem was.

GMG that ticketmaster unilaterally decides for me what the "best available" ticket is. I get that this is done to keep some order/avoid single tickets, but I'd still prefer to choose my seat at a venue within a price range.
