That's pretty much always been the rule, it's not called often unless the impact is quite violent more often than not. The onus is on the player throwing the hit, as well as the player being hit to not intentionally put himself in that position that results in him being hit in a bad manner. Now if it should be a rule is debatable, I would say no a hit like that should not be a penalty, but it is a rule currently so you can't really fault the ref's for calling it as they did.
As far as consistency in calls... you do realize we are discussing the NHL right? I get the point you are trying to make and I do agree, if I had my way anything that wasn't an obvious hit from behind or a blatant and intentional boarding play would not be a penalty, but sadly (not so sadly in this particular case) it is.

ya the last two playoffs he has been poor, that's why I don't mind moving him all that much
he's still a 45-50 point guy though on arguably a discount contract and I think someone would be willing to pay a price for that
Corrado/Tanev aren't the same type of guys offensively, but both can move the puck well which has made any of the other guys on the 4.5-5m salary expendable and the value would be most for Edler

Daniel Sedin complaining about the reffing. Virtually said that they deserved better because they held off on the diving this year.

People who believe the penalty was a good call keep missing the key word defenseless in the rule.
This hit, the Cooke hit, a the Clutterbuck hit were all similar with this one being the least violent. This one was called a penaly, the others werent.
