After a quick search, it appears that a security guard has the same powers to arrest and search as any citizen. So if they do arrest you, they are making a citizens arrest.

Don't take that as correct though, what I read could be wrong or out dated.

Cadillac Fairview owns (or did own) both Chinook and Market Mall. The two places were run completely different when it came to security. Chinook was well run, Market Mall....well that is another story.

Hey now, I wasn't even commenting on the situation at hand, but rather a comment about mall cops. Your rage is ill-directed.

As for this situation, I'd like to see how it shakes out before coming to a conclusion one way or another.

The reports say they employ Paladin. If Chinook used it's own staff, then why would Paladin need to do an investigation into this?

Errm, I meant during me dealings with them, which was as mentioned 5 yrs or so ago. That being said, the security department management was CF employees. They set the policy/procedure for the mall.

I have many conclusions on 31-year old wastes of space who annoy the #### out of people in malls as well, I just hadn't responded to any posts about that particular subject yet.

Chinook used to be in house.

Back in the day I toiled as a security guard. From what I remember security was given care and control of the property which allowed that to arrest any criminal activity (summary or indictable). Unless it has changed a citizen back then could only arrest for indictable offenses (come to think of it, I vaguely remember hearing that it did change).

Bottom line you have to check your ego at the door or else you are looking for problems. If the guy is leaving the property you have to just walk away. Unless there is more to the story it looks like they jumped the gun for sure because waving/fingering or tossing a coffee cup isn't really grounds for arresting and detaining someone. Especially with that much force.

Just in case anyone decides to fight cops or security in the future, here is a tip:

When you are on your back and they're trying to put cuffs on you, stop moving. It is a pretty easy way to stop yourself from getting punched, kicked, held down, etc.

I have seen it a number of times, but yeah there is a good portion that are completely disillusioned abusing their so called power. IMO it was over compensation being labeled the rent-a-cop/mall cop. It did kind of make you shake your head knowing that they wanted to be cops.

Excessive force for sure, I don't care what he did or didn't do. To me it just looks like an excuse to beat someone up. The amount of security guards on top of him was a little much. They ask the guy to put his hands behind his back. How exactly? Its impossible when you got 5 guys holding you down.
