Gretzky trademarked a lot of slogans. He probably couldn't trademark The Great One because it's too generic as a phrase.

Apologies as I'm unable to link right now - hopefully someone else can - but TSN legal analyst, Eric Macramalla @ericonsportslaw, posted a quick summary on Twitter just now.

Seems it may be for an image and not the phrase?

Well, "hockey player" and "working girl" probably aren't in the same categories for the purposes of trademarks, so there might be some leeway there.
