This feels like it's going to badly backfire for TransCanada and the GOP. Democrats will easily to be able to run in 2016 on "The GOP thinks foreign companies should get whatever they want". And as mentioned Canadians would be utterly furious if an American company tried this here, and Americans will be furious too. Could be a big mistake politically.

This is what the GOP fails to mention when talking delays by Obama. There is lots of resistance by landowners and states environmental agencies. I think even if Obama said to get er done, there would still be a lot of red tape.

Obama ain't approving that pipeline, bottom line. It would take a particularly strong prior set of delusions to mistake what he's said about Keystone as any indication that it's not totally dead, at least during the rest of his presidency.

American oil companies do it here all the time. Right of Entry orders are not all that uncommon. The Alberta government sells the mineral rights to an oil company without any thought to the landowner. The oil company then creates a proposal to drill and pipe the results. They start by negotiating with the landowner but if they can't agree then they go to the surface rights board where a judge will assign the right of entry and the oil company can then go ahead and drill the well/construct the pipeline.

In the whole procedure, the country of origin of the company or the final destination of the product is not a concern. It shouldn't be in the states either.
