Not going to defend Smith here but I'm sure if you took your BAC at 7 a.m. on a Sunday morning after a big night of partying you'd still blow over so the 7 a.m. thing doesn't surprise me that much.

ya I had to go to emerg one time after a night of drinking and when my blood results came back I was still twice the legal limit at 8 am. It's not uncommon to see checkstops set up in the morning around christmas time and catching people still blowing over from the night before.

Don't think that will happen. Somewhat incredibly, even after driving to work still smashed and possibly high, after wrapping his car around a tree (thank goodness it wasn't a bus stop) and so out of it he kept the foot on the gas, Harbaugh said he had his "wits about him" at practice and didn't notice anything odd, and has said he'll play Sunday.
I doubt the league will do anything before the game under the personal conduct policy even the guy has been in the news a lot over the past few months with other off season stuff.
Now, if this was a 3rd string defensive back barely above the practice squad, he'd be off the team by now, or, if this was an opponent the same Harbaugh would be asking the league to throw the book at him.

Demarcus Dobbs had a similar situation last season and was kept out of the next game. But Demarcus Dobbs isn't as good a player.
And personally, I think that is wrong. It shouldn't matter how good of a player your are. It is a sport and that shouldn't have any bearing on the punishment.
But we all know money, celebrity and fame all mean there is a different system of justice.
I think he should be gone for multiple games as of right now. There is no grey area here.

It led, sources said, to the collector's willingness to substitute another person's urine specimen for Miller's. It might have worked, sources said, had a second collector not discovered that Miller was not in the city where his collection was supposed to have taken place.
