Not going to defend Smith here but I'm sure if you took your BAC at 7 a.m. on a Sunday morning after a big night of partying you'd still blow over so the 7 a.m. thing doesn't surprise me that much.

Authorities say San Francisco 49ers All Pro linebacker Aldon Smith is out of jail following his arrest on suspicion of driving under the influence and marijuana possession.

Santa Clara County Sheriff's Sgt. Kurtis Stenderup says Smith posted $5,250 bail on Friday morning, just hours after he was taken into custody by police responding to a solo vehicle crash involving a pickup truck in San Jose's Silver Creek area.

Police say Smith was arrested after officers gave him a breathalyzer test and determined he was under the influence

That loaded he smashed his truck up? Yikes.

Also this isnt his first rodeo with police matters.

ya I had to go to emerg one time after a night of drinking and when my blood results came back I was still twice the legal limit at 8 am. It's not uncommon to see checkstops set up in the morning around christmas time and catching people still blowing over from the night before.

Don't think that will happen. Somewhat incredibly, even after driving to work still smashed and possibly high, after wrapping his car around a tree (thank goodness it wasn't a bus stop) and so out of it he kept the foot on the gas, Harbaugh said he had his "wits about him" at practice and didn't notice anything odd, and has said he'll play Sunday.

I doubt the league will do anything before the game under the personal conduct policy even the guy has been in the news a lot over the past few months with other off season stuff.

Now, if this was a 3rd string defensive back barely above the practice squad, he'd be off the team by now, or, if this was an opponent the same Harbaugh would be asking the league to throw the book at him.

Demarcus Dobbs had a similar situation last season and was kept out of the next game. But Demarcus Dobbs isn't as good a player.

And personally, I think that is wrong. It shouldn't matter how good of a player your are. It is a sport and that shouldn't have any bearing on the punishment.

But we all know money, celebrity and fame all mean there is a different system of justice.

I think he should be gone for multiple games as of right now. There is no grey area here.

Suspended Denver Broncos Pro Bowl linebacker Von Miller unsuccessfully attempted to corrupt the NFL's drug-testing program with the help of a urine collector before each was caught in a matter that will affect how the NFL's collection testing procedures are done moving forward, league sources said.

This helps explain why Miller's four-game suspension for violating the NFL's substance abuse policy suddenly and mysteriously was increased to six games and easily could have been up to a year, the sources said.

Miller's initial diluted sample counted as a positive test and led to notification of his four-week suspension under the NFL's substance-abuse policy. While Miller's reps and the NFLPA were prepared to fight the suspension vigorously in the appeals process, sources said the NFL, NFLPA and Miller's representatives became aware the Broncos linebacker and the collector involved worked together in an attempt to help Miller avoid a failed test.

Sources said the collector worked in Miami, where Miller spends offseason time, and the collector reveled in knowing the Broncos linebacker while being, according to a source, "star struck." It led, sources said, to the collector's willingness to substitute another person's urine specimen for Miller's. It might have worked, sources said, had a second collector not discovered that Miller was not in the city where his collection was supposed to have taken place.

he is such a great football player and "seems" like a good guy otherwise, but its just one thing after another with him.

This path he is on is all too familiar IMO, and the ending of these things is never good.
