Since Jan 2016 it's been allowed under ObamaCare, but few states have passed laws to try and make it happen, and there's been no interest from insurance companies to do it.

3) each individual state needs to pass legislation in order for this to even happen.
the third point pre-dates obamacare and is the purvey of individual states and the first two are sink costs for the insurers...so there's no reason for them to do it if there's no profit for them to do so

Yes, Congress can ignore Trump. They pretty much are ignoring Trump. This demand should change little. It might encourage some of the more rebellious Republicans to continue to the charge, but the pragmatic ones should move on.
