I'm almost positive this is the actual reason he does it. He can't be fined because he's actually wearing the tie.

There have been occasions where Burke is there with lametie and someone is right beside him with no tie. I don't think it's a policy.
I couldn't care less about his ties and hair, but I do worry about why he looks like a heart attack waiting to happen. That redness in his face just ain't normal.

He does it to make a point that he's a grumpy old man that doesn't like ties. Instead of just not wearing one, which no one would care about, he makes a scene about how much he hates them.
It's embarrassing.

I suspect he just doesn't like doing up the top button on his shirts; probably chafes the neck. The untied tie is a natural extension of the desire for comfort.
I've heard straight from Brian Burke about how this came about. He's done this for decades dating back to his Hartford days.
He doesn't like ties and finds them uncomfortable. So when he's watching games from the press box, he eventually undoes his tie and leaves it around his neck so he doesn't lose it or forget to put it back on. Back then, he would do it up again when he left the press box to speak with people, address media, etc...
Sometimes he just forgets to put it back on (I personally think he's reached the No F's Given stage of his life). Over the last few years people starting noticing and making an issue about it. Which he finds hilarious: "I used to have to go out of my way to annoy people. Now I can do it just by putting a tie around my neck."
So there you go. The saga of Brian Burke's tie.
