It was a tongue in cheek response to the suggestion that something the Black Hawks organization (with its tawdry ethical history) would consider to be a material breach of contract might not be considered unethical enough to prevent another team from signing Perry. If Perry has done something that is so bad that it doesn’t even meet the Black Hawks’ standard of conduct to the point that the league released the team from the obligations of his contract, there is no way he should be eligible to play elsewhere. As with the slap on the wrist the organization got for conspiring at the highest levels to cover up sexual abuse, the league is continuing to show its favouritism toward certain franchises.

He's destined to go there. Remember the Oilers had a deal in 2003 to acquire Perry and a first for Mike Comrie but then pulled out of the deal because they wanted Comrie to also pay them back for his $2.5M bonus?

Yes, but the NHLPA will appeal it if they feel an appeal is warranted and the termination was without proper cause. See Evander Kane.
