A few new pieces of information for me in here, I didn't know so many non-SCOTUS judge appointments were being blocked, didn't know 'judicial emergency' was a thing, and also didn't know about the Recess Clause.
Quote:
Pursuant to the Recess Clause of the Constitution, “the President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.”
There is precedent for doing so: President Eisenhower did this in 1956, when the Senate was in recess, installing Justice Brennan on the Supreme Court. (He was confirmed when the Senate returned in 1957). And while the Senate can remain in “pro forma session” to avoid a formal recess, the one time it can’t do that is when a new Senate has been elected but not sworn in. In other words, there’s a window.
Of course, as the Constitution says, the recess appointment only lasts until the end of the next legislative session. But that’s two years, during which time Justice Garland serves on the Supreme Court, absent any congressional action whatsoever. And not just Garland – President Obama could name recess appointments to the dozens of vacancies in the federal system.
That would be, to put it mildly, a contentious act. But with Republican Senators going on record in favor of a permanent stonewall, the outgoing president would have ample cover to do something, anything, to end the judicial emergency they have created.

I really hope Obama does that. The public opinion would definitely be on his side with how childish the Republicans have been about this, and the GOP would go berserk at having their ball being taken away from them

The public sentiment would probably be very mixed. A lot of polls show a majority of citizens fear a more liberal court than disapprove of a blockade.

I could be wrong, but I believe the Republicans have been using a loophole where even when they're in recess for practical terms, all they need to do is have one senator come in every 3 days, gavel congress into session and then out of session, and technically never actually enter a recess.

Yeah, the article mentions that there's a window where that won't work.

The systematic takedown of Trump by Harris and Sullivan is something to behold though.

Her experience as First Lady alone would have made most shy away from public life ever again. Heck, even the demonization and vitriol directed at her during the 1993-94 health care effort would have been enough to deal with for most.
I think these experiences have shaped her. It's bound to. And I think people interpret guardedness and carefully chosen words (to a fault?) as her being entirely disingenuous or having some innate quality as a dishonest person. I just don't think that's true.

Oh I'm dying to hear your insights on this one. Are you trying to suggest there has to been an endless string of attacks on the Clintons since Bill took office almost 25 years ago, and they have not continued while Hillary has been in the public eye?

I suppose most politician who reach the pinnacle of being a presidential nominee have similar inclinations. But I guess the benefit of being a career politician is you realize along the way you have to have a message that resonates to somewhere around half the population.
