Yes!

The Oilers traded their first round draft pick in 2026 to the Sharks and it is only top 12 protected.

So if the Oilers miss playoffs but finish in the 17-20th overall spot (like the Flames did last year) they would miss playoffs and still ship their pick to San Jose

Their pick is top 12 protected. Looking at probably .5% of keeping that pick.

I think if they traded 2027 1st then the sharks can agree to remove the condition this year or something like that.

Every non-playoff team is in the lottery, but only the bottom 11 teams can move up into the first overall spot (and bottom 12 into the second overall spot).

Also, there's a good chance Bowman gets desperate (or is forced by Katz) and trades their 2027 first before the deadline, meaning San Jose gets their 2026 first no matter what.
