In my experience, this is usually the strongest motivator.

Yeah I always get a kick out of whenever someone who has never actually tried to pursue a constructive dismissal charge acts as if it’s some cake walk to get compensated for. Especially when it’s in Alberta.

If you have savings and secure living conditions (I did), then just walk. Literally nothing says you need to give two weeks notice, just close your laptop and walk away.

For an individual employee that’s actually a pretty short-sighted move to be honest.
Assuming you still needed to find a job afterwards in most cases employers would be less inclined to hire someone who not only sued their previous employer but also went out of their way to publicize it.

I was 'Seeing Red' and my lawyer was honest, its the 'Nuclear Option' its hard to win, he thought I had a good case, but either way I was pissed.
But I won and I got a haul but more importantly I taught them how much fun it is to hurt other people out of spite and how much it sucks being on the other side of that equation. So herein the lesson is: Treat People Well.

Unfortunately the only lesson they took was: treat people well, if they’re in a position to afford a lawyer and actually hold you accountable when you don’t.
Same as most other areas of law there’s two legal systems, one for those who can afford a lawyer and one for those who can’t.
Good on you for winning your case, as your lawyer said it’s a rarity.

My significant other left her job at the beginning of July and tried to get on EI via constructive dismissal. It seemed like a straightforward situation as a breach of employment contract but apparently the Service Canada folks did not see it the same way. Her employer stopped remitting deduction and paying those to the government. She would still get her regular pay amount, let's say $6000, but she wasn't getting pay stubs saying she earned $10K and $3,500 went to income tax and $500 to CPP and EI. This happened for a few pay periods and when she questioned the employer after the first occurrence she was told they would catch up with remittance when their cash position improved.
Apparently this wasn't a breach of employment contract though although I think if she pushed the matter with Service Canada she could get that decision overturned but she doesn't want to bother playing the governments game.
