I recently made a police report about events that occurred moments before a fatal motor vehicle collision. Before I made the report, I conferred with the other two people in the vehicle with me at the time of the events to ensure that my perception of events was correct and that I wasn't missing any details, then I made notes in my phone before talking with police to give them as accurate and complete a report as I could.

Having said that, between texts saying that they needed to get their stories straight and texts saying that everyone just needed to tell the truth, there is possibly an appearance of collusion but probably not enough to convict someone on, even if they had been ruled admissible as evidence.

I think there’s a lot to this. It’s very possible that with the benefit of hindsight, assuming no crime was committed (in reality or in their own minds) that there was real concern that they engaged in behaviour they should not have. Not defending their actions at all but I can see young men struggling in this and other situations.

Not defending him, but this isn't true:

The allegation against Dube is that he slapped E.M. on the buttocks without her consent. “While I accept that the slap took place, I do not accept that Mr. Dube was one of several men who took turns slapping her as hard as they could,” Justice Carroccia said.

The guys who set this up and the splits guy seem like the worst to me. Dube seems like a loser follower.

I knew it was somewhere.

That said, whether they should have been admitted or not (and whether or not that ruling is appealed), let's not talk about "innocence" any more.

As soon as the texts were thrown out, it felt like the crown lost all of it's momentum.

How can the judge accept that the Dube slap took place (assault), but then find him not guilty?

Because the prosecution didn't prove beyond reasonable doubt that the slap wasn't consensual.

As always I think the truth lies somewhere in the middle, and unfortunately someone had to pay for this with their personal life.

Sad, but prosecution failed to generate any sort of momentum in the case.
