The problem is that it would be hugely impossible to determine intent.
So, it’s a penalty regardless.
If it wasn’t a penalty you would see players routinely tossing the puck out.

Or maybe it's okay to give the Oilers credit, and they're doing a good job defending to keep the opponents shots for low. It's been consistent with any of their opponents in the playoffs.
