Default 3 years for preachers wife who shot him in the back while he slept

Quote:
The family had a pizza-and-movie party that evening. The girls were tucked in, and their parents eventually went to bed themselves.

In the wee hours the next morning, as her daughters slept elsewhere in the house, Mary Winkler picked up her husband's 12 gauge shotgun, aimed it at his back as he lay in bed and fired a single shot from less than 3 feet away.

She then left him there to die a slow death amid his own pooling blood, fleeing with her daughters to the beach for what she knew would be one final getaway with her girls.
No...not only celebrities get away with ridiculousness in the justice system.

so murderers get 3 years, but a 17 year old kid who has consensual oral sex with a 15 year old girl gets 10 years in prison and a lifetime on the sex offenders list. the US has some real messed up values on justice

of course Canada isn't much better, but at least we're universally soft, and not completely ass backwards

I think this is where the statement "It is a legal system, not a justice system" comes into play.

From chapter 3:

The Winklers were facing financial despair, like many young families with a modest income and a nursery full of children. Mary Winkler, her family's bookkeeper but something of an Internet naïf, likely fell victim to one of the religious salutations as a way of getting her family out of debt.
Prosecutors say Mary Winkler was drawn deeply into the scam, eventually depositing two fraudulent overseas checks totaling $17,500 in family accounts, and then shifting the funds to other banks in the financial shell game known as check kiting. Withdrawals and wire transfers are made on the bad checks before the fraud is discovered.
Bank officials at two Tennessee banks, Regions Bank in Selmer and First State Bank in Henderson, caught up with the scheme on the day before Matthew Winkler was murdered, and the couple bickered about the problem.

So why does first degree murder get three years in jail? Did the jury feel sorry for because she feel for 419 scam, did she plead insanity or depression or what?

Guarantee you that if it was a male who shot his wife in the same situation, he would get life.

"I was upset at him because he had really been on me lately, criticizing me for things, the way I walk, the way I eat, everything. It was just building up to this point. I was just tired of it. I guess I just got to a point and snapped."

It was the "I just snapped" defense that got her off lightly.

The judge believed that the abuse that she suffered during the relationship was a mitigating factor.

Though nothing was proven in that respect.

She complained that he made her perform sex acts she considered unnatural...such as wearing platform shoes and a wig.

To make this even worse? She could be out in 60 days.

A woman who killed her preacher husband with a shotgun blast to the back as he lay in bed was sentenced Friday to three years in prison, but she may end up serving only 60 days in a mental hospital.
Mary Winkler must serve 210 days, or about seven months, of her sentence before she can be released on probation, but she gets credit for the five months she has already spent in jail, Judge Weber McCraw said.
7 months for killing another human being while they slept. Swell.

There does seem to be more legal defense avenues for woman in murder defenses, and judges seem to have more sympathy and leniancy from woman then me.

This case is no different then a case like Dorothy Joudrie who shot her husband, claimed a shakey catatonia case and received limited time in a cushy upscale mental hospital instead of going to jail where she belonged.

The only time that woman see harsh punishment is when it involves the murder of thier own children.

But she can blow away her husband, cry abuse and the judge won't even challenge it.

I read about Genarlow Wilson too. Sad story that is.

And yes, women get treated much much better in every facet of today's society. All this equality crap has shifted the balance the other way. Funny isn't it?

Yup. Men are almost always guilty until proven innocent in cases like this. Especially when they have been butchered and can no longer speak in their defense.

What is chilling to me is the way I read the story and her talking about a "final fling with the children". After which she was going to turn herself in. I'm thinking had she not been apprehended in another 24 hours her kids very well could have been victims as well.

But as far as a case goes I think it may very well be more complicated than woman kills husband in cold blood. I'm not sure any of us have anyway of knowing whether or not she was abused. There was evidence for both sides on that. Her demeanor changed throughout the marriage. Was it a case of abuse of some other mental problem? Is it just something people perceive as a person ages, has kids and becomes more responsible?

To be honest, if she didn't want to participate in oral and anal sex because she didn't feel it was natural and she was forced into it by her husband, if he did actually threaten to kill her, if he did physically abuse her...I would have a hard time finding sympathy for the victim.
