Smoking ban will apply to First Nations: health minister
The new smoking ban will apply to reservations, but already the band leaders are saying they will not abide by the law.
Ron Morin, the chief of the Enoch First Nation, said his group won't abide by a provincial directive to ban smoking.

I hate this arguement... I didn't take anyone's land... no one that reads this site went down and spread disease. Yes it is reprehensible what happened, no one will deny that (or at least they shouldn't) but how does that relate to certain bands deciding not to follow the laws of the land at the current time. It isn't as though it is a law designed to persecute native groups.... hell when you consider the addiction problems that run rampid on native reserves the leaders should be welcoming any initiatives designed to limit ones access to potentially addictive substances...

can they do that? I thought that native reserves fell under federal jurisdiction and provincial statues needn't apply. I could be mistaken though.

ummm...this is a tough one. I think since reserves are more of a private dwelling than a city is, I dont really mind if they are given the option of going to no smoking. Perhaps a referendum in each of the reserves is the most fair solution.

The government does not have the right to regulare the goings on inside of it. This is what 'self-government' means. They police themselves and make their own laws... to a certain extent. I don't think the provincial government has the right to ban smoking on what is essentially private property. They tried it in BC and you can still smoke in bars on reserves in BC. At least, you could the last time I was there.

In cases of Canadian race relations I always believe our two tier system of racial rights will continue until proven otherwise.
So following that rule, smoking will still be allowed in public places on reserves.

This judge in Manitoba struck down their smoking law because it DIDN'T include native lands.

Well Firefly....you nor I are Constitutional experts so we will have to wait and see what plays out in the Supreme Court. I know what you are saying but I think you are making it way to generalized as to say they have to be treated as private property, when that is not the case.

Sorry. I have to cite laziness. I didn't read the article. I responded to the title under the impression that reserves had special rules about them, where native culture should dominate. If smoking isn't as frowned apon in a culture, I think they should be allowed to do what they want, hence my referrendum comment. If it's in casinos where they want us to come spend our money, my opinion is that the smoking ban should stand.

So you are saying that someone who doesn't pay taxes due to the treaty agreed upon by the government don't deserve the same rights as you do? Where do you draw the line there, do natives not deserve the right to vote, I mean that is the way that the majority of us express our voice, through the ballot box. I hope I am just not understanding your arguement on this one.
