Are NFTs like HD DVD used to be? Super hyped, then a massive flop?
My take- and yes maybe similarly to HD DVD in a way- is that this is just a technology/innovation way out of its time. When there's actually a usable metaverse that people are interacting with and inhabiting on a usual basis, then it will be useful to have a way of creating limited edition or completely unique pieces of art or items that people can possess within that space. But until then it's super ####ing useless.
No it isn’t. Not unless you make money from it or sell your designs. I’m not aware of it ever being challenged but it would likely be considered fair use. But the very fact there are literally millions of cosplayers and they never get sued is a sign that it isn’t infringement.
No, it's a sign that it would be a bad business practice to sue, especially since you'd only be able to get statutory damages if there's no actual harm to the copyright holder.

But even if/when the exemption doesn't apply, if there is no financial gain, there is nothing to claim damages against. And therefore zero reason to pursue, which makes it effectively non-applicable.
Seriously, I don't understand the problem here. Is it the whole punching a firefighter thing? Is that the holdup? Have the Flames Foundation donate to the Firefighters Kids Toy Charity and have Scorch say he's sorry.... problem solved.
Hell, Brett Sutter once punched a guy and he's the team captain.

Adirondack Flames (AHL) introduced him as their mascot, with a video of him killing a firefighter. He lasted 5 days before being cancelled, but has remained in the hearts of Flames fans ever since.

The killing the fireman cancelling was part of it but scorch also looked like a costume that was put together the night before the reveal in a rush. So they were being mocked for how terrible it looked as well. So they just dumped it and went with a boring mascot instead.
