He should get at least 10 games. Although considering how much the hockey world (and media) seems to adore this jackass, and the NHL's love for the Oilers in general, I could see him getting as little as 5 or less.

He jumps Tkachuk after clean hits. He kicks a guy in the chest after the guy did nothing wrong.
Imagine what he would do if someone actually did something dirty to this guy.

I know there's slightly more padding on the legs, but if that skate hits the wrong spot and slices the major artery in the thigh, a person can bleedout in like 60 seconds or something like that. So leg isn't much better than anywhere else on the body.

I also don't get how he can waive the right to an in-person hearing. Obviously those hearings are reserved for more serious offenses, which this is.
Anyone have a clue how it works?

You're entitled to an in person hearing if they want to suspend you more than 5 games. Otherwise they can just talk to you over the phone. If you waive your right to the hearing they can suspend you for any number of games over the phone. It changes nothing except that he won't be defending himself live and in person.

I would also imagine he would have someone there from the NHLPA to help represent him if he did it in person?

In the Post game interview, Kassian admitted to kicking him with his skate and said if he wanted to, he could’ve kicked him harder and he would’ve felt it

He probably was given a warning last time and knows he’s going to get the hammer dropped on him so it’s not worth going in person. I hope he gets at least 10 games but I imagine it will be more like 2 games cause the league does not seem to take things like this seriously until someone gets hurt... at which point it’s already too late.
He keeps playing the same way year after year... doing things to try and hurt guys out there. If the league seriously wants to stop him before he ends someone’s career, they should send a real message and give him a huge suspension. He might actually assess the way he plays if he has to sit 20-30 games while losing a third of his paycheque his year.
