Yeah just because you write something into a contract it doesn’t always make it legal. You can’t deliberately confuse/deceit/hide unrelated things in small print.

GullFloss, When you do get the car back, take it to Urban Expressions. They are awesome. I have been getting tires from them for years. I will never get tires from anywhere else.

Go there with your phone obviously recording and ask for your keys back and tell them it’s illegal to withhold the keys to your car. They will know what your doing and just comply. If not videos going viral

When the dealer held my car they said I had to buy new tires and they would install them at no charge if I bought them from them OR elsewhere. I ended up having the dealer price match some where else and had them install them for me.

I think you need to have a chat with them about whats going on. Take a look at the tires. Are they falling apart and unsafe?

I'd prefer they keep you off the road if you have unsafe tires on there personally.

I was young and stupid at that time so maybe they didn't have the right. But when I went in and looked the tires were actually coming apart! I felt really stupid.

I went to get a tire fixed at OK Tire and they looked at it and said the tire was splitting and they weren't comfortable fixing it and having me drive on it. This was before they did the work so I had options not afterwards to hold my vehicle hostage, Kal Tire sucks. If there was an issue they should have refused the work.

Did I miss it? Do we know which location this is yet?

I had a much less serious interaction with them about 5 years ago. My youngest had just entered daycare, so we were paying close to $2000/month in daycare costs. We had almost no money at that point and I took a car in for service and they charged me about $100 extra for some premium service that I "requested". When I told them it must have been a simple misunderstanding because there's no physical way I would ever agree to an added service at this point in my life, the manager told me I definitely asked for them.

Long story short, complaining to their customer service team on twitter was hilariously effective. The manager called back and told me corporate had contacted him and now he "had" to give me a refund. His tone was so obnoxious I just ate the $100 and let corporate yell at him for a few more days. One of the more petty things I've ever done but it was satisfying.

Growing up in the Okanagan Kal-Tire was always the best shop to deal with, probably because they're based in Vernon. Seems like they haven't been very diligent with their expansions though as their service quality has really taken a nose dive the further away from Vernon you get in recent years

Doesn't matter to me. If he needs new tires he 100% needs to go get some but it's not Kal Tires duty to ensure that he does

True, but if his tires are completely bald, hats off to the manager for having the balls to take matters into his own hands. I'm not going to stick up for a guy's right to drive on unsafe tires - I don't think you should have that right, particularly in winter. I'd like to see a pic. If they're objectively unsafe, I hope the manager keeps the keys until he buys new tires either there or has the car towed to a different shop for tires.

#### that. I don't want him on bad tires either but the manager needs to do this legally and just report it. He's not the batman of tires, he has zero legal right to hold someone's property. And let's not forget he's not doing this because it's the right thing to do, he just wants the sale

My brother owns his own Fountain Tire, and out of curiosity I threw this situation at him. Posters are already correctly advising you, but for what it's worth from someone in the industry:

What they are doing is illegal. They cannot withhold YOUR property from you. The best they can do is document it, warn and advise you, then release the car to you. If this were a thing, there would be nothing stopping any salesman from saying this whenever they wanted and selling 4 new tires every visit.

He suggested that you contact the police and show up with a couple officers to get your property back. And as others have suggested, take it somewhere else and get tires.

Yeah, I don't support him doing this to get the sale. I'd bet a million dollars the manager would hand the keys to OP once the tow truck was there if he was going to tow it somewhere else for tires.

Maybe the manager is being a bit of a pr**k, but the bigger pr**k move is driving around on these roads with bald tires, so I'm giving the edge to the manager until we see a pic.
