The costs awarded are pretty low - just what courts normally give to a winning side. If he'd ruled it was frivolous he would have awarded "solicitor client" costs which would have been a lot more.

FWIW, it wasn't actually dismissed as frivolous. It was dismissed as improper jurisdiction. Henderson is bound by the CBA between the NHL and NHLOA, which sends him to arbitration.

The "want of jurisdiction" will return at some point should he not be able to settle matters with the NHL/OA I'd guess. One would think that at some point a Court will be involved. (Largely because I can't see the NHL paying out a dime, ever.)

The Flames never had anything to do with Wideman's actions.
I'm glad nothing came of it, and he in fact had to end up paying the costs for trying to drag the team's name into it. Was a #### thing to do.
Don't get me wrong, compensation was deserved, but it should've always been through the league and arbitration behind closed doors and not in a way that threw shade on the organization and gave refs more incentive to slight the Flames like has quietly yet evidently been the case since 2016.

I doubt very much Bettman is stupid enough to award Henderson $0, since that will almost certainly end with what you say - a return to court. As it is, Henderson is appealing the Queen's Bench decision to dismiss the case.
If it ends at arbitration, we'll most likely never know what the final pay out will be, since it will be guaranteed to be under an NDA.

The lawsuit was not dismissed even. It was stayed pending certain determinations including jurisdiction first being made in arbitration.
CTV describing it as a "failed" lawsuit is really not accurate.
Maybe it never comes back to court (though I understand the ruling is being appealed) but Henderson has not actually failed at least not yet.

Agreed. Not sure why the NHL was so adamant to oppose settling in this manner. I'd assume they are either insured, or have chosen to self-insure. Just a cost of doing business. But I guess if you can get someone else to pay the bill....?
I'd forgotten that he eventually appealed. Will be interesting to see what may come of that. (in another decade?)

Guy knew the NHL was about to send him packing and tried to cash in

I don't know, people can have weird reactions after a traumatic incident. While I agree with the judgement and disapprove of Henderson's lawsuit... I don't think the fact that they had an on ice exchange might indicate he was lying about his pain and suffering. He may have felt fine until the evening which is very common in car accidents etc... He did not ref in any more games. The fact that he was cordial to Wideman after the hit doesn't have a bearing on his motive or case.
I do agree that when you play the sport are involved in the sport, even as a fan there is some risk associated with the event, much like driving every day.

Neither him nor Wideman wanted to have a bad blood on personal level, so they sort of chuckled it off. It does not necessarily means that it was a fraud by Henderson.

It's quite possible Henderson was injured somewhat the way he states but this is Canada and it wasn't a $10 million dollar injury, he may have got some sympathy if he went after $$$ similar to other work type injury's or even auto accidents but he went after 10 in hopes of a 5 out of courter.
The people he tried to sue are way too smart for that.

No, he was reportedly being pushed out and force-retired prior to that.
I dont know anything more, and he likely did get hurt, that was pretty vicious, but I still believe Wideman wasnt in his right mind and never really intended to do it.
Unfortunately it gave someone an opportunity to try and cash in and he did exactly that. It just hasnt worked out the way he wanted it to.

He can always go back now and try to sue the other refs for not stopping play when Wideman got hit. That might have prevented this chain of events.

That's what it came down to - he got greedy and ended up with nothing and deservedly so... that was a ludacris amount to ask for. Doesn't mean he was fine after and was a fraud.
