I'm not sure of all the rules for player designation, but I'd think they could classify Jagr either as a "Non-Roster" player since he's not with the team in Edmonton, or place him on the IR essentially as a conditioning assignment.

Either one of those would allow his contract to be registered without taking one of the 23 roster spots. I'm not sure if the league would allow that, but I believe one of those two options would work.
