What a bush league mistake by the judge. I don't care how busy you are. You are about to send someone to prison for a long time. It just took me 30 seconds to note up s.230 and 8 of the ten first hits were all SCC decisions. That should have probably been a flag.

Dennis Thomas, Q.C., of Edmonton is appointed a judge of the Court of Queen's Bench of Alberta. He replaces Mr. Justice D. Perras who has elected supernumerary status.
Mr. Justice Thomas received a Bachelor of Laws from the University of Alberta in 1968 and a Master of Laws from the University of London in 1970. He was admitted to the Alberta Bar in 1969 and to the Northwest Territories Bar in 1975. He was appointed Queen's Counsel in 1988.
At the time of his appointment, he was a partner with the firm Fraser Milner Casgrain and practised primarily in the area of environmental regulatory law.
In the past, he has been a frequent panellist and lecturer for the Canadian Bar Association, the Law Society of Alberta, the Alberta Forest Products Association, the Alberta Chamber of Resources and at the Cambridge Lectures.

as an average citizen it is really frustrating to think that there might be some chance he walks on this due to a mistake made by the judge.
my friends wife worked in the corrections system, and she commented on how he is not a nice guy

Yeah they'll appeal but it's pretty much over. I doubt anything comes of this appeal.

I'm very ignorant on the legal system, so this could be a turbo-dumb question. Was there actually enough evidence to get Vader on 2nd degree in the first place? If the judge had spoken differently, could there have been a way to properly get him charged with 2nd degree murder?

My understanding is that based on the evidence provided by the Crown, the answer would most likely be no on a conviction for 2nd degree. I believe 1st degree was initially sought by the Crown. No bodies and no murder weapon obviously are the major problems.

This POS was sentenced today, eligible for parole in 7 years. What a joke. Still claims to be innocent and wants to clear his name. If anyone deserves a prison shanking, it's this tool. He made such a mockery of our justice system throughout the trial to boot.

Hopefully the simple fact he has shown no remorse, still claims to be innocent and has not disclosed where the bodies are will keep him behind bars when his parole hearing comes up.
I so feel for the McCann family in what they have endured, I can't imagine.

Agreed, that's why I asked. I don't believe he will be out in 7 years, because of the reasons you stated. And if he is going to get parole then, he likely will have reformed quite a bit and maybe even admitted to it or where the bodies are.

hopefully the parole hearing in 7 yrs is more of a formality and that they sit down and as soon as vader opens his mouth they say sorry, the eharing is over you get to stay in a cage
