If you understanding is "pretty poor" and a "haze" I would suggest that you should educate yourself.
I would suspect that the lawsuit has been started by her. Her insurance policy might have a clause that allows them to recover monies paid out as a result of the negligence of another party (either from her, or from the negligent party).
You have been posting about how it is sad a lawsuit has been started, it isn't sad. What is sad is an individual has had a life changing incident, and if she or those around her feel this is the best course of action, so be it.
I would say that questioning why someone needs to start a lawsuit in this type of situation makes you look like an ass.

Have you read this thread at all? There are multiple people stating, since page 1, that her insurance company has been the catalyst to this lawsuit.
You seem to be incapable of engaging in conversation, but I like to entertain the ideas that other people bring up. I consider them myself, and think "hm, that does make sense. Good point." You should give it a whirl. Believe it or not, there isn't a jury at the end of this picking a winner. It's a conversation, where people share their opinions -- and don't have witnesses and research to back it up.
You suspect that the lawsuit has been started by her, but what education do you have above mine that leads you to suspect that? Do you have a copy of her insurance to prove what clauses it does or doesn't have? It sounds like you're just offering an objection to what others in this very thread are saying with no base for your argument. I am at least listening to others and taking the opinions and knowledge into account to have a conversation. Your inference that I am the ass is a pretty clear indication you haven't read a thing I've posted and just like to pick points to strengthen your soapbox.
I also asked you to quote something I said that prompted you to bring up the severity of her situation. I see you decided to quote something else and deflect.
Honestly, I was hoping for a conversation. Instead, I have an argument. The irony is, my whole conversation started around "I wish the world was a better place". It would be nice if your response was merely your opinion and not 'shut up, you're wrong'.
I'll also note that humility in my opinion and discussion should be kept out of a topic you've decided to wade into. It seems to be a target for your ire. I'll be more bullish about my opinions or just shut up unless I have proof for everything I'd like to talk about.

Here's a good read regarding the waivers and how enforceable it is with respect to sports. From the news article it looks like the players did sign a waiver but the specifics of certain conditions and where negligence could arise (bad ice) was not clear and unambiguous in wording.

She may have a case as the duty of care lies with the organizers (NHL, Patriots, NWHL etc.), and that duty was breached. The organizations' CGL (Commercial General Liability) or E&O (Errors & Omissions) policies would be the ones to respond as she tries to subrogate against them.
This would be similar to the concussion lawsuits.

I'm pretty sure people on this board are more upset at the possible lawsuit than the parties involved.
The league and Pats should expect this, and if you were lying in bed paralyzed you'd look after yourself too. A waiver is supposed to cover the risks inherent not negligence as I understand.
These things are all about the insurance companies anyway, her insurance is going to sue theirs, it's nothing personal, just business.

Saw this thread near the top, came to read hoping for a good news update. Scrolled through 4 pages of debate over lawsuits and the level of sympathy the family should get.
Leaving kind of disgusted and definitely disappointed.

First of all, there is no way that this is the insurance company at this point. I've been involved with subrogration cases before, and they drag on forever before they get to the point of litigation. I doubt the process would even start before the bill was finalized. And if anyone has dealt with American health insurance before, the one thing that can't be accused of is doing things quickly!
I don't see anything wrong with her suing in this case. Some people are sure quick to cry frivolous lawsuit at every chance. She should just ask the NHL and Patriots nicely for $100,000 and be done? If they were to hand over the money, I'm sure the NHL would send over their lawyers to have her sign away any further liability by taking the money.
She suffered a very substantial loss while being part of the entertainment for a large, profitable event. She's likely in a complicated legal position by not being employee or contracted player, so she won't get the same benefits an NHL player would get if something happened. I don't see anything wrong with her hiring a lawyer to handle this as lawyers do.
