You're only granting the benefit of the doubt to one person in this situation.
Of course it does. Arguing that a false accusation is a real possibility doesn't mean that's what I believe is the truth but rather a counter arguement to the people who seem to be trying to dismiss it.

Reading about this case, where no information has been forthcoming by either side, it's amazing the debate going on. Of course lots of people would prefer this to be a terrible mistake or misunderstanding. Some go as far to think a huge plan to get money. Now comes up subject of guilty people going free, innocent jailed. One thing I know,when guilty go free, and it happens a lot, there are more victims. That's why it's important for this to be tried in the courts, not by us, I guess.

I think it's becoming more and more clear that this is a case of them starting to have consensual sex and then her wanting to stop (probably after the biting). No evidence of a struggle or forced entry or anything like that, plus a condom, plus the witnesses saying they left together and the lack of a charge all point to that.

Question is did Kane stop right away? One of two things would have happened. Either he didn't and it's rape or if he did, she could've still felt "violated" and truly believed it was rape even if it might not have been.

Doesn't change the fact that it's still he said/she said.

Which is why I think these types of cases should either go to court because there is sufficient evidence or not. Paying a big settlement shouldn't even be an option. If there is sufficient evidence I think paying for treatment is fair and maybe some pain and suffering but paying to make it go away seems greasy for both parties.

The fair penalty is they go to jail like all other convicted criminals. Ideally I think it would be nice to recieve compensation but I'd assume most victims of crimes do not recieve financial compensation. A lot of criminals probably do not have money to fairly compensate anyways. I'm far from opposed to making criminals pay victims compensation but determining what is fair in each case is a difficult thing to do. Paying for all treatment seems fair and easy to determine but pain and suffering is a whole different story.

If someone is indeed found guilty of a false accusation like the woman in the Brian Banks case then I definitely think she deserves jail time as well.

So. Update. Seems that the lawyer of the accuser is going to do a press conference on Wednesday. Stay tuned I guess.

I've been on the side of im waiting to hear the results of the Judicial system process but holy f*&! does this put a damper on that idea.

Brutal.

Her lawyer also says he has never settled a monetary claim and he's the last lawyer in town you'd go to get a fiscal settlement. So there goes that idea that this is a money grab.

What would be the reason to do something like that? Wouldn't that evidence need to be locked in a police station or something while they await trial?

One theory is that someone was being a whistle blower to show it was tampered with. Otherwise - I don't really know why you'd do it.

To be fair he mentioned HE was not involved in any talks with regards to a monetary settlement but could not confirm or deny that his client had done so without him.

thats what makes the most sense to me

did it anonymously

Lawyer inferred it as well saying they need FBI/State troopers to get involved, basically accusing the local PD of something

Yeah if it was somebody destroying evidence or tampering with evidence on Kane's behalf no way it gets sent to the mom.

Feels like a whistle-blower trying to show there is an issue with the process within Buffalo PD and stuff is being tampered with.

All very weird.

Regardless of the reasoning behind it, if that bag is the evidence bag there is an issue with this case being dealt with fairly.
