Or make knowingly false and damaging statements about someone?...

Free speech doesn't protect you from consequences of those words. Having a bad day and call your boss an "idiot", you'll be fired before you know it. Free speech doesn't protect you from that, you're still responsible for your words.

I'm fine agreeing that we have a different place for that arbitrary definition....sure.

Unless you are suggesting salacious gossip is somehow equivalent to a death threat? That's a false equivalency and a straw man argument.

Although sports message boards are not renowned for their nuanced discussions.

That's the theory at least, but is it actually true? "Engagement" like that seems like a meaningless buzzword.

What does this engagement really get TSN? It would be interesting to see the numbers. It can only be a small fraction of their audience actually tweeting at them and they are probably not a particularly attractive demographic to advertisers.

I would think a much bigger chunk of their audience is at least somewhat turned-off by the endless inane chatter and busy screen. I know I am. I don't care what some jerkoff in Mississauga has to say, and if I did care, I'd look it up. So I didn't watch, even for a minute, this year. I had their actual Trade Tracker that simply put actual trades on the screen.

It's like reading the paper, and they have random letters to the editor mixed in with the actual journalism. At least online sources put the stupid stuff at the bottom where you don't have to see it if you don't want to. TSN and everyone else putting twitter on TV is just jamming the dumb down your throat.

All kidding aside though, if this went to court in Canada, am I correct in assuming that it's not sufficient for it to be false and that Phaneuf et al would have to show actual harm?

In other words, it's not sufficient for them simply to say that this hurt their feelings, correct?

Am I afraid to say that TSN is threatened with being sued for posting a tweet about Lupul having intercourse with Phaneuf's wife? No, because it's a fact.

I would be afraid/stupid to post the tweet as fact though.
