Are they ahead of schedule? My work was without internet because our internet gateway comes from Shaw Business in downtown. We were told they'd gain access to fix it on Wednesday, but suddenly we woke up this morning and our websites were working again.

Shaw's building is outside the affected area. Shaw had some damaged fibre but they have spliced some new cable in and their services are coming back. Enmax isn't even finished pulling cable yet.

This sucks. My office is closed for the week but I took this week off to use up my vacation, so I am using vacation days that the rest of my office gets off for free!

I'd call Service Alberta about that one, I don't think that's legal.

Yeah I'll bring it up when the office is back open next week. Not overly concerned about it, it just kinda sucks when you think about it.

As a safeguard you could notify them in writing that you were back from a planned vacation effective Monday and wee (and still are) available for work.

Why? What does the companies misfortune have to do with his vacation plans?

If he planned to take this week off anyways then it is certainly legal. It wouldn't be legal for the company to say "the office is closed this week so everyone has use their vacation days to cover the time we'll be closed."

I wouldn't, especially if you are working for a small or medium size business. Your company is already taking a massive financial hit. This is the sort of thing that can influence how your boss thinks of you and your character. It's not like you are getting screwed out of something you earned here.

You're out of office anyways. Why does what happen to those that stayed in office impact you? You got your vacation as expected. They just happen to got some bonus days off. Sure it sucks and I'd gripe about it too, but I don't think you have a legal ground to stand on.

If you work for a company that is currently closed and they don't have business interruption insurance after what happened in June of 2013 you work for a stupid company.

I have an employee that is on vacation this week and he will be getting every single day back and more because he worked Sunday and Monday updating our website.

Vacation is not earned?

A guy tried to do that last year when he was on vacation during the flood and the office was closed.

It came off as extremely petty and I wouldn't doubt that it affected his standing with the group.

I would let this one go.

And office closed doesn't necessarily mean they aren't working (from home).

Could you possibly confirm this?

From what I've seen, closing the office/shop for christmas/holidays and forcing employees to use vacation days is pretty standard practice.

I can't give you an official ruling but I would think that a planned closure for a holiday period with notice is acceptable because of notice involved.

If the electrical system is downed and employees are available for work then it would be the responsibility of the employer to make arrangements for the utilization of employees. Last year during the flood aftermath my company still operated in a modified capacity by running backup generators for power. Employees that could work from home did so and those who needed to be at the office went in.

Keep in mind that I may be talking out of my ass and using logic where it may not apply.

Never heard of that being done, wouldn't call it standard practice. Unless of course your vacation time resets January 1st and they force employees to use their unused portions (totally within their right so they don't pay it out).

Mind you, the way the regs read, they have the right to do that at any time. It's a ###### move thought, which is why it's rarely done, unless they want to start losing employees.

Which is possible but improbable for most. It's difficult to work remote when there is nothing to remote into.

I work at a company that has a Christmas closure from Dec 24 until Jan 2, but they make you take 2 unpaid days in there. The upaid days are forced, you cannot even opt to use your vacation days. That's the part I don't understand - if I have extra vacation, why can't I use it?
