If they base this purely on eye witness accounts Tony Stewart is a murderer.
Lets not.forget a gross number of these eyewitnesses are race fans.
Most of these people are.more credible than 100% of.people who have never in life attended a live race and dont know a darn thing.
Video replay doesn't tell the whole.story.
Anybody thinking it does should think again.
I didnt wade into this discussion for debate or discussion on what they beleive. ....the facts will be proven.
My personal beliefs say Tony just killed a guy and is likely gonna walk away unscathed.
Sad sad day as a race fan....I liked Stewart.
Not anymore.

Just a cold outsiders view here... I don't watch racing, I have no idea about the physics involved or how likely it was that he didn't see the guy until the last second, and I never heard of either of these guys until this happened.... but it "looks" suspicious. Again, I am not claiming to be educated at all on this, but as someone else mentioned, it looks like he tried to maybe freak him out by turning into him a little, and got too close (I have seen road rage incidents when drivers do similar things).
I would like to believe that a race car driver would be more professional than that, but after hearing about this incident and watching other videos of this guy, he seems to have a lot of contempt for people.
On the other hand though, the victim was not smart walking out onto the track like that.

If Stewarts actions were to intimidate the younger driver, I think he is at fault but only he knows his intentions. If I were driving down an icy street and revved the engine to throw snow at a person and killed the person, I doubt I would get away without being charged. Like Stewart, I understand how the conditions will affect my vehicle's performance, I have years of experience in the conditions, and I have no intent of harming the individual. It is an accident but I am responsible for my choices.

I read today that they can't find the GoPro that was on Stewart's car, it went mysteriously missing, funny thing that he pitted right after the accident...

While it's odd that the GoPro is missing ... I would think immediately pitting would be pretty logical if you just ran someone over.

Given the fact that not a single one of those eyewitnesses has any clue what was going through Stewart's mind, there is no way you can use this to justify the argument that Stewart intended to kill Ward. You need to show/prove intent to make a claim of murder.

An article I read yesterday said they don't use GoPro cameras in the races so I am not sure how it went missing. His car also comes to a stop on the racetrack from what I recall seeing in the video.

I would think stopping immediately and going over to check on the guy you just hit would be more logical. I don't know where Stewart went after but I know it wasn't to check on the victim.

Doubtful Stewart ever goes to jail or gets charged with anything for this. There is an inherent, assumed risk of death in race car driving, even moreso when a driver is on the track with the cars moving. It's an unfortunate accident, but it obviously never happens if the guy stays in his car. I know it's been done before, but it was reckless and stupid before and luckily nobody got hurt. Sadly this time someone did.

Also, I think in any race car, drivers are almost entirely focused on the cars right in front of and around them. They know the track thoroughly, so they don't need to focus as much on that. Unless someone came on the headset and told drivers that a guy was walking on the track, I doubt they'd notice until they were practically right on him.
Add in that Stewart was right behind another car, it was night and the kid was wearing black, and I seriously doubt Tony knew he was there until a second or two before impact.
Just because the video shows the kid angrily pointing at Stewart from all across the track doesn't mean that Tony knew that was going on.
All that said, it's completely believable to me that Stewart might have wanted to come close to the kid or gun the engine to give him a scare, but without some sort of voice recording of him saying that or some sort of black box technology that they certainly don't have, I can't see any way for a conviction or even charges.

Worst case scenario if he stays in the car is that Ward Jr. eventually finds Tony in the pits later and we have a good ol' fashioned dust up... Youtube gold.
There are a lot of facts that will come out eventually, but for now my only standpoint is had he should not have put himself into that situation. Judgement withheld for now.

That would totally fit Tony Stewart's personality too. The guy has admitted anger management issues, he loses control all the time.

I wonder if Tony regrets what he said earlier when he had that wreck with Kenseth where he got out of his car and threw his helmet at Kenseth's car and then said in an interview: NASCAR’s Tony Stewart to Matt Kenseth: I’ll ‘run over him every chance I get for the rest of the year.
THat tells you all you need to know about Tony Stewart's control of his emotions.
