Actually the law pertaining to mental health is very specific, once someone is deemed no longer of risk to the community, ie on their meds and the meds are working, then they have to be released, their are no provisions that Lin can legally be held long term assuming his meds are effective.

Day release is part of a process that will inevitably lead to his release reletively quickly assuming he has no set backs.

The perception and treatment of persons with mental illness has changed over time, including key developments in the criminal justice system. Since 1992, amendments to the Criminal Code have increased the rights of offenders found not criminally responsible by moving away from the prerogative to hold persons for an indeterminate period of time.
Quote:
Many argue that persons with mental illness who offend enter a cycle of criminalization where they are more likely to return to the criminal justice system than those who are not mentally ill. Specifically, the 2006 final report of the Standing Senate Committee on Social Affairs, Science and Technology reports that a cycle is perpetuated by the absence of an adequate transition from correctional services to community-based treatment or support programs. It was stated that the "lack of continuity" often puts offenders, particularly released offenders, at risk of experiencing a number of problems. According to the report, not only do many released offenders with mental disorder come into (re) contact with the criminal justice system, they also tend to look for other means to alleviate their problems, such as self-medication with illegal drugs. This is particularly the case in the absence of sufficient treatment and adequate access to community support and constant stigma and discrimination.

You implied it when you asked how they would find him if he missed taking his meds. With two people escorting him at all times, how would that be an issue?

When I read the story below it made me think about this bus attack. Makes me sick thinking that a father can almost kill his own son and yet be assessed as only low risk. Are you kidding? The system is screwed up and needs to be fixed even for the mentally ill. I know a guy that almost killed his ex and her boyfriend with a shotgun and he was out of jail before a buddy who went away from growing 100 marijuana plants. As mad as it makes me I kinda smile knowing that if I ever need to murder someone I won't spend much time in jail.

However, Hepner said now the man has been assessed as a low risk to reoffend and has support from his family and community.

The weird thing is you can get sectioned on a reletively minor crime, I had a kid who pushed a cop and so was done for resisting arrest, but as he had an IQ of around 68 and was also possibly psychotic, he was found not guilty due to diminished responsibility and then proceeded to spend 4 years in a secure hospital when he would have spent at best a month in on the equivalent criminal sentance.

It is a very strange world when you start visiting pysch units.

The story says he will be part of a group that does have an escort. So, although it's not one on one as it was before, he isn't completely unsupervised.

Edit: I think I might have misread the article. I think he gets unsupervised trips to Selkirk, but group outings to bigger cities?

I have no problem with it. Unless you do not believe the assessment of the professionals.

When it happened he was undiagnosed as a schizophrenic.

Now he is in a facility and is a model patient, always taking his medication.

He will still have a supervisor and will still be in a facility.

I don't think we should lock people up indefinitely who have a mental illness that can be successfully treated.

Locking up people indefinitely is an entirely different argument - its pretty hard to argue to let them out when you're talking about a crime as brutal and disgusting as this. There are a lot of schizophrenic people out there that aren't treated at all and they do not go around beheading people on buses. Its semi offensive to think that all mentally ill people are being thrown into a lump with this guy - he is not an average patient. The fact is that there are legitimate concerns that this guy could disappear and go completely nutbar again because he's off of his meds.

Do you want to be sitting next to this guy on the next bus trip he takes?

I'm sorry but when you chop off the head a guy sleeping next to you on a bus, carry it around taunting people with it and then proceed to eat the corpse....no kind of sickness excuses that, he has an evil in him that will never be fully cured. He should be at the very least be locked up for good but really the cops should have just shot him, its a shame this never happened in Ontario with the trigger happy OPP.
To let him have unsupervised visits is sickening.

It's a travesty this guy wasn't blown away. I am not a huge revenge fantasy guy. But I really hope someone takes out this guy. Whether he meant it or not, what he did, puts him below the status of a rabid diseased animal, or fecal matter.

I understand he may not have been in control, but sometimes that just doesn't matter anymore. Some people are so broken, society truly would benefit for them to just die. You are human scum not matter what. If I had woken up from a daze and found out I had done something this heinous, I would be looking for anyway I could to end my life.
