I read somewhere that the Sheriff said they considered if this was a stand your ground case but decided it didn't meet the criteria.

If it were not assize time, I would totally gun down every person texting in the theatre!

Apparently this guy wasn't just a police officer, he was a pretty big deal in the department and subsequently was the head of security for Busch gardens. If THAT guy can't be trusted to use a concealed weapon responsibly I'm not sure who to give the gun licenses to... I guess, no one.

I'm surprised how many people on Facebook responded with "well, it IS pretty annoying when people text". I can think of something slightly more rude... Some are joking of course, but others seem to creepily miss the point.

And he likely wasn't texting with a 3 year old, but rather whoever is watching the kid. It's not unusual to text a babysitter before you sit down to eat or watch a movie. I can't believe I even had to write that.

Not sure if it was mentioned in the article posted, but the man was texting during the trailers apparently, not the movie- not that it is justified either way, but important to point out.

And an off duty deputy jumped up out of his seat after the shot was fired- strange that he waited that long, as the loud argument was happening for several minutes before the shooting.

So you're telling me that there was a good guy with a gun present at the scene and yet the murder still happened? WHY DID YOU LIE TO ME, NRA, WHY?

You're right, it probably isn't important to mention it, but my point is that people texting or talking during the previews is fairly common and you will usually see it quite often. I've seen arguments over texting/talking during the movie, but never during the previews (except Elaine in Seinfeld).

I think adding in the gun is the more relevant component and your latter part about a hot temper is more accurate. Mental instability might be part of the equation here, but I think this would have happened either way- a fight breaks out, the older guy is possibly losing, so he takes out the best thing he can to counter the other person. In the heat of anger during a fight, this guy is going for his gun whether he is mentally stable or not (imo). Had the gun not been present, the fight is over in moments and everyone goes home

From the accounts published so far, there wasn't even a fight in this case, just some popcorn being thrown.

Even so, I think having popcorn thrown at him probably infuriated him enough that in the moment, he might as well have been crazy- I don't think he needs to be mentally unstable beforehand to react the way he did. Without the gun, the worst that happens is a fight.

Intent, clearly he was using his weapon to take out the popcorn that was flying at him, hell there may have been kernels in the mix, we just don't know. The round missed the target and hit buddy, sad/unfortunate but when you go aroiund throw popcorn, #### will go down!

Bit OT, but texting is an awesome, practical way to get your kids interested in reading and writing. My kids, five and seven, have phones (hooked up to our wifi, the phones aren't allowed out of the house, and they're not on any carriers). They're Android phones, so they can use Hangouts (you could do it with iPhones and use iMessage, too) to text over wifi. When my daughter gets home from school she is supposed to text me how her day was, and I text her back how mine is going.

We tried everything to get her interested in reading and writing and nothing was working particularly well for the longest time. Texting completely changed that for her and us. Now she enjoys reading, reads books, etc. and it's been really neat watching her abilities improve over the months we've been texting by looking through our history. I turned off predictive text and make sure to always write to her in complete sentences (versus abbreviated 'text speak').

Anyway, back to the thread, but just wanted to point out cell phones are a great tool for kids when used properly.
