Charges stayed: http://www.calgaryherald.com/news/ca...154/story.html
Quote:
Two assault charges against Calgary Flames’ prospect Michael Ferland in connection with a bar fight in Cochrane last summer have been stayed, according to Alberta Justice records.
|
Quote:
“It frustrates me to see that a court trial may be the only way to bring out the truth. Unfortunately, I can’t control what other people say or do. All I ask is that the police, the prosecutors and the court look at the evidence the same way they would if I wasn’t a professional hockey player,” said the statement, issued through Ferland’s lawyer.
Ferland’s lawyer, Michael Bates, said the defence was seeking additional witnesses. Bates said he’s aware of at least two witnesses who have alleged someone other than Ferland committed the assaults.
“It’s not surprising to me, as a criminal defence lawyer, the versions of what happened are many and varied,” he said.

Ah! I believe it is Jim Rome that always says "Nothing good ever happens outside a bar at 2 AM". Crazy how these athletes never quite get the message. One bad move at 2 AM = One potentially screwed up hockey career.

Reports suggesting charges laid against Flames prospect Michael Ferland have been dropped are inaccurate according to @660News.

According to @660News Ferland's charges (aggravated assault, assault) have been moved to Court of Queen's Bench.

I don't know any of the particulars, but if the charges were "stayed", that does not mean that they were dropped. They are essentially temporarily withdrawn (although it is my understanding that they are often never prosecuted).

Yeah and then charges were laid at a different level of the courts as per the article above.

Stayed charges mean they are discontinuing the prosecution. Normally this happens when there is not enough evidence or the prosecution are waiting on further evidence.
The charges can be brought back in front of the court within 1 year of the stay date. However this hardly ever happens unless the person is a complete tool and gets charged with another crime during that year.

It also happens when the charges are going to be re-tried in a higher court as dammage points out above.

For what reason would the case get promoted to the higher court without even a trial at the lesser court?

This is from the Herald article on the charges being moved:
Quote:
The Crown last week stayed assault and aggravated assault charges against Ferland, 21, then served him with a direct indictment on the same charges to the higher court to have them heard by a judge and jury.
Recently, the Crown has been issuing a lot more direct indictments - either before or during a preliminary hearing at provincial court - but has so far rarely direct indicted when the accused’s choice of trial is at the lower court.
|
Not fully sure what that means other than it gets a judge and jury trial and that they have being doing it more often lately. Doesn't say why they did it specifically in this case but one of the many Lawyers here probably know more about it.

Indictidable charges are much more serious than summary charges. Aggravated assault is much more serious than assault. If convicted, good luck getting into the Us. Indictments are kind of like felonies. For the record, I am not a lawyer.

I think I was able to decipher most of that.
It doesn't sound to me like it was only a little innocent bar fight. Sounds to me like Ferland went way overboard and will be looking at jail time if he is found guilty.

Wouldn't be surprised to see a guilty plea to a lesser charge that doesn't screw up his potential hockey career.
