If it's unsafe people could get sick, which means increased health care costs. So i don't there is any benefit in lying and if it was a lie we would find out and Nenshi would be toast.

If he does and he shouldn't, there's a landlord/tenant dispute resolution service that doesn't cost much that you can go through to get it back.

Never thought of that, yeah.. and getting it gutted and redone is now is probably going to take a lot longer than if it'd happened a few months ago just to one place.

Thank you everyone for your reply. I should have clarified. I have e-mailed my landlord twice, but so far I have not heard anything back from him.
I understand that we are on the hook, but in this case the condo management company can not give us a time frame.
I was talking to a co-worker who said that because the Landlord is not able to meet the conditions of the lease agreement (a place to live) that the lease can become voided.
To be honest I love my place, and do not want to move, but depending on how long this drags on, I need to know what options are available to me.

No luck with the Service Alberta line right now - it just says they are experiencing a high volume of calls and instead of putting you on hold, it just hangs up.

That would likely only be true if your house in uninhabitable after you are given the green light to go back.
As harsh as it sounds you are on the hook for the rent even if you can't be in your place for a couple of weeks. Being forced out of your home because of flooding won't void your lease, it will only be voided if your house is not safe to live in after the fact.

Oh no worries, Im not taking it personally, I just seem to be getting two trains of thought on it, so happy to hear any and all advice.
The term I keep hearing is the Lease is now "Frustrated" and because of that fact rent should at least be pro-rated.
I also just got a text from friends two buildings down that will not be charged July rent. I now this is a landlord decision, but it seems somewhat muddy.

In addition the tenant usually has to apply to the court to terminate the tenancy:

I don't think the lease is frustrated, it's not a situation where a landlord hasn't met their obligations (under the definition of a landlord's obligations under the law). Things have to have an opportunity to be resolved.
This site even specifically mentions floods:
http://www.landlordandtenant.org/liv...ge.aspx?id=602
Quote:
Q.My apartment has flooded and the damage is going to take about two months to repair. Do I have to keep paying my landlord rent while the repairs are taking place?
A.
Yes. If you stop paying rent you are at risk for being evicted for non-payment of rent. Even if you have to move out while the repairs are taking place you should still pay rent. It is possible for you to come to an alternative agreement with your landlord with regard to the payment of rent during this time. Any agreement should be in writing and clearly state what your intentions are in altering the terms of the original lease agreement and be signed by both of you. In the absence of such an agreement you should keep paying rent. You can also give notice to end your tenancy, if it is periodic, with the required amount of paid notice.
If you have tenant's insurance, your rent or extra living expenses may be covered by the insurance.
If the premises are completely destroyed by a disaster such as fire, it is likely that the lease agreement could be treated as frustrated (i.e., unable to be carried out) and the agreement will be over. However, if premises can be repaired so that the contract can continue, the contract will not be frustrated.

Got through to Service Alberta. For my situation, they said it's up to me and my landlord to work it out as there is no specific law applicable in this case. I also asked for J-bo and they said you'll have to pay the rent, but if you really want you can apply to the court to terminate and then it will be up to the court to decide (as other posters have mentioned above).

This is going to be an issue, it always is after large incidents. The hails storm that smashed Carstairs down through to Carsland/Arrowood area 5ish yrs ago, produced a large number of "roofing companies".......
I would warn people to make sure the contractor they get is qualified to complete the type of work for which they have been hired.

However, with no background at all on this subject, I would think you are still responsible for your lease, you should have to pay. You should also be able to possible get some of that funding coming in, but I don't know.
As for this:
It takes two to tangle. Call him!

Totally agree, and I think the city/province is worried about that as well. We had people walking around Bow Crescent this morning talking to everybody to make sure that their contractors are accredited.

Hey so what should they do with the 300 idiots in High River who refused to leave their homes. I think the Gov't should just exclude them when they offer funding for the town later on.

Someone in government - might even have been Redford - already said those 300 people will not be getting the $1250/$500 debit cards.
