Thumbs up D.O.M.A. dead, Gay Marriage legal in the USA

In a ruling by the supreme court, they decided that the Defense of Marriage Act was unconstitutional based on discrimination. Therefore, the government can now only determine a marriage as being a marriage whether or not the couple is straight or gay, all legal distinctions are equal. If a state determines gays can marry, their marriage is legal in those states, but it does not transfer.

SCOTUS still deciding on Prop 8, the California Marriage Ban. Does the DOMA ruling affect the Prop 8 decision?

It just ruled that it cannot determine the ruling on prop 8. The people who brought the case to the supreme court were deemed not valid to be able to bring it to court.

In effect, it means that gay marriage is once again legal in the state of California as the lower court ruled that, and the legal decision was differed to the lower court.

As someone who lives here, this is long overdue. Of all places, California should have been the leader in this arena. Unfortunately, it took the courts to recognize that the democratic process was running contrary to basic civil rights and had to make a tough decision to overrule the population.

That being said, this is a battle that is on it's last legs for the opposition. It's only a matter of time for all 50 states to follow suit. We are now at the point that those who are vocally against this sound as backward as those who were against the African-American civil rights movement in the 60s.

I am hopeful that this country recognizes that this is the time to make the change and becoming fully accepting of gay and lesbian couples.

What I do like about the supreme court is even decents that I disagree with are always very well written and based in law. Very rarely is there ever an unreasonable argument being made.

I'd love to agree with you, but there are a number of States that are a long ways away from taking that step, just as there are many States that have only very recently accepted the equality of African-Americans. The fight is far from over, but this is a huge step.
