Former Toronto Maple Leafs general manager Brian Burke has filed a lawsuit saying he was defamed in online comments accusing him of having an affair with a sports reporter.

Burke alleges online comments published by the 18 people whose identities are unknown to him are untrue.

The online statements claim that Burke was fired as the president and general manager of the Toronto Maple Leafs because of an extra-marital affair with Rogers Sportsnet reporter Hazel Mae.

The civil suit says Burke is suing for losses and damages to his reputation because of untrue the statements and in a news release, Burke says the comments have also hurt his family.

The former Vancouver Canucks and Toronto Maple Leafs general manager’s lawyers have filed an action in B.C. Supreme Court Friday alleging defamation against several unidentified Internet commentators who “have spread lies about Brian over the internet, following Brian’s dismissal as GM of the Toronto Maple Leafs.”

The notice of civil claim says the Internet commentators were spreading lies, alleging Burke had a sexual relationship with a female sports reporter, and may be the father of her child.

“The Defamatory Statements have been published, republished, downloaded, viewed and commented on by persons in British Columbia and Ontario and throughout Canada and the United States by various means, including through email, internet bulletin board postings, Facebook pages and Twitter messages, and have harmed the Plaintiff’s reputation in, amongst other jurisdictions, British Columbia, Ontario, and other parts of Canada and the United States.”

The usernames listed in the claim are: “NOFIXEDADDRESS”, “CAMBARKERFAN”, “LAVY16”, “MBSKIDMORE”, “TULOWD”, “LOOB”, “NAGGAH”, “MOWERMAN”, “AARONP18”, “STEVE”, “KABOOMIN8”,“THEZBRAD”, “SLOBBERFACE”, “POONERMAN”, “ISOLATEDCIRCUIT”, “KANADA KEV”, “NCOGNITO” AND “SIR PSYCHO SEXY”.

Online defamation is a fairly new field of lawsuit. I'll be interested to see how this trial goes.

Edit: Also, quite classy in that none of the hosting sites or their operators have been named as defendants, although all of them can probably expect to be served with third party document production orders some time in the not-too-distant future I would think. Still, nice to see there's no attack on the innocent site operators.

Yeah, it's an interesting question. The users are named as the defendants and the sites in question are only used as reference, so I don't think CP itself has anything to be worried about, but I wonder what they're obligated to provide with regards to the user's contact information.
