Kipper would be a great option for a compliance buyout (depending on the team involved). I am assuming that you would have to payout only $1.5 Million, but you get rid of the $5.8 Million cap hit. Re-sign him to a $3-4 Million per year contract and you have lowered your cap hit by $2-3 Million and you give him solid incentive to stay in the NHL. Could be a good option for Toronto, etc.

Is there anything in the compliance buyout that would prevent signing with the team that just bought you out?

I think personally this was blown out of proportion, I'm not sure if Kypreos even had all his facts in order. The tsn guys didn't seem in line with his thinking, there definitely is interest in kipper no doubt.

Well there's a cost associated with finding replacement services most of the time, and with some things you could lose a lot simply by not having a service provided for the time period it takes to replace, but that's not really applicable here. You could probably come up with a bunch of scenarios where there would be measurable damages. Even if you came up with a way to do it here it's simply not going to happen. We've already seen how this plays out with the likes of Nabokov.

You are correct. Generally speaking, It is not possible for an employer to contract out of its obligations under human rights or employment legislation.

The team that bought out the player is not allowed to re-acquire him in any way (signing, trade, or waiver claim) for a period of one year after the buyout.

The Bylaws even specifically spell out a case where a player is traded but retires prior to reporting to his new team and in that case the player is deemed retired and the trade voided.

That aside, even if he did something that was considered a breach of contract (i.e. failure to report without retiring), it's not like this isn't all spelled out in the publicly available CBA and SPC. There are really only 2 options for a team when a player breaches his contract by failing to report. They can either toll his contract and prevent him from playing in the NHL again without fulfilling the terms, or they can terminate his SPC.
Plus he's not saying he even wants to do that. What he wants to do is play for the team he signed with for the full term.

According to TSN the speculation is Kipper will retire after this year however they still have him in play and did not say anything about him not willing to move. Said Feaster and Kiper talked about it awhile ago so that would be before the baby by the sounds of it. Anything confirm Kypreos story yet?

Dreger said on Sportscentre that Kipper's statement was less of an "I'm not reporting to any other team!" and more of a "Run a trade by me before you sign off, okay?"

From my understanding you can't do that, that would be a huge loop hole if you could

Which is really Kipper just giving Feaster a heads up. If he gets traded to a team that he's really unhappy about, and would just not report and retire, then he really screws that team over. You can say the Flames should try to deal him anyway and hide that fact from the other team, but that's just dealing in bad faith IMO.

He created a NTC for himself, Kipper is the man! I'd keep him here till he was 50. I actually wouldn't be surprised if Kipper played for 1.5mill and signs an extension.

Aren't you one of the many that guaranteed Iggy would sign an extension with the flames?

That sounds more like something Kipper would say.

Jay Feaster approached Kiprusoff's agent (L.Kelly) 10 days ago. Kelly told Feaster if there's trade potential consult with Kipper first.#TSN
So does this mean that perhaps Kipper won't outright deny a trade, he just wants to be consulted ala a NTC?

Here's the video on tsn.ca with the Kiprusoff stuff, starting at 1:27 in. (Hope the link works)

This really wouldn't be a bad thing. Kipper certainly hasn't been the problem with this team and the Flames best goaltending prospects are at least 3 years away.

Based on Kipper's rapidly declining stats over the years, that would be the last thing this team needs. He really should move on after this year.

In case anyone missed it, Dreger just said on TSN that IF Kipper is traded, his agent told the Flames to make sure they talk with him first.

Basically, Feaster approached Kiprusoff's agent and asked him of the possibility of being traded. Kippers agent said IF he is going to be traded, consult with Kipusoff before you pull any triggers.

Never said anything about refusing to being traded, or not reporting to any other team. Kypreos is the only one that heard this rumor...

That's false info. If you need to lie to support your argument, maybe you should ask yourself why you have that opinion in the first place.
