Just responding to clarify on this. Since the case would have to go through appeal, I would imagine that for the time being that O'Riely couldn't be on the Flames roster as well the Flames wouldn't be able to use the 1st and 3rd round picks (for trade) since those are pending due to decision. Therefore, they technically wouldn't have them though they haven't officially given them up yet. Now, Flames can still use them if they wish.

Agree. I voted "C," even though it's not entirely representational of how I feel. Which is that he should not be fired. I just think so for different reasons.
Namely, because I think if COL had not matched, and this issue had gone into litigation, we might've had a shot at getting O'Reilly in the lineup this season. The wording in the MOU states "a team's reserve list," and O'Reilly was on "a team's" list. Colorado's.
If the spirit of the amended clause was to allow teams to bring players over from Europe during the season without penalty (avoiding a Nabokov situation), and that's what I believe, then it's far from black and white.
So there's that. Additionally, if we can believe that the 29 other GMs, the league office, and the agent in question were all not aware of the complexity of the situation, I'm letting Feaster slide just a little because he had the balls to go out and be aggressive and make this move. If ownership is pressuring against a full rebuild (and I think they absolutely are), then this was an aggressive and strategic move (in the sense that the contract was intended to be very difficult for COL to match) that I want my team's GM to pull the trigger on.
Gonna be an interesting Hot Stove tonight, like someone above me just mentioned. Friedman is pretty connected and I'll be eager to hear if there's any more insight into what might have been.

I don't think it's unreasonable at all to think that ME has a personal understanding of the intent of that clause. Not claiming that he did, just presenting the possibility into the discussion in this thread.
As for precluding Feaster form liability and responsibility, I never said that.
One of the primary criticisms of Feaster in this is that he didn't call the league - and that is a valid criticism that I have also made.
On that issue, someone said that Feaster should have talked to someone who knew what the rule was.
I posited that ME might well be one of those people.
But I also said that I have no idea whether Feaster talked to him about it.
The fact of the matter is that it is still uncertain as to whether the allegations against Feaster are entirely accurate, and I am anxiously awaiting word from the league. On this, I think it is certainly a possibility that Feaster and ME talked and that they are completely confident in the rule. I am not stating that that is what happened, but it is a possibility.

And would they still be able to retain his rights even if he sat out, or would he have to go on waivers right away?

It's a slippery slope though. The point of RFAs is to limit the power they have over the teams that have their rights. If they don't have a hard deadline for when a player has to stop playing in Europe, it gives more power to the player.
The balance of power between teams and RFAs is very important to 29 other teams in the NHL. Ultimately, if the Flames had to be a casualty, it's probably something the NHL as a whole would accept and could live with (especially after Feaster just essentially killed 2nd contracts before the CBA ink was even dry).

Basically the premise is no harm no foul but the crux of the matter is, I just don't like that the poor move we made which left us completely open and vulnerable if Sherman had the knowledge to expose us.
We were lucky that Sherman was like Feaster in the sense that he obviously wasn't aware of the clause or misinterpreted it like Feaster.

The "anti-offer sheet" statement is a bit misguided; sure, its not used a lot.
However, in this case the twist is that had ROR not played in Europe post lockout, there would've be no waiver condition on the Flames.
Not as "Pro (COL) GM" as I think you're thinking in this case.

I have to believe that Feaster was right and he knew what he was doing. Anything else is too unsettling and depressing for me. Ignorance is bliss and koolaid is delicious.
And hey, it could be worse... our GM could be Sherman.

I'd like to think that.. But he couldn't have known for sure that the Avs would have matched, and then we'd be in a whole world of trouble. Feaster would probably be fired by now if it did happen too, Hindsight's 20/20 I suppose though.
Also, for the flack that both GMs are getting for this situation Sherman's a pretty good GM, I'd take him over Feaster given the chance.

Listening to the Fan yesterday, and they said they were surfing around the net and that the general concensus was the Colorado fans think Sherman in an idiot for matching. They hate the contract for that calibre of player. I know fans aren't always the best measure, but it sounds like many want heads to roll there too.

You shouldn't be, you should wake up in a cold sweat at night wondering what Feaster's next "home run" is, to squeak this years team into the playoffs.
I would have much prefered him have the "brains" to avoid needlessly embaressing the franchise that's going to happen on hockey night in Canada tonight
