Calgary man furious he wasn't informed his attacker had his charges thrown out
http://www.calgarysun.com/2012/12/17...m-was-released
So he was viciously stabbed, "died" twice on the operating table and these bozos didn't think to call him and let him know that his attacker was released.
And to top things off, his attcker goes on and stabs and kills another man only a few months later.
And then gets charged for manslaughter. I don't care how much heat I get for this, but the Canadian justice system is an embarassment.

Ya I don't think you will find to many people disagreeing with you on that point.

To be fair, the original charges couldn't be proved cause the attackers face was covered and the victim couldn't positively ID him. Thats why he was released.

The word you're looking for is martyr or messiah.

That, I'm fine with. Nobody should be put in jail if they can't even be positively identified by their victim without other sufficient evidence. I can live with those charges being dropped.
That still doesn't excuse not phoning the victim and giving him an update on the case.
And getting charged for manslaughter a few months later for stabbing someone to death is a joke. The laws need to be changed to make it easier for a prosecutor to lay murder charges instead of the easier manslaughter charges. He'll probably make a plea deal and be out on the streets in less than 10 years where he'll go stab some more people to death.

I'm not sure why the Crown would need to notify a victim, but it would be the reasonable thing to do. How what was likely nothing more than an administrative screw up turns into "the Canadian justice system is an embarrassment" is pretty hard to figure out, but any chance you get right?

How did I know you'd chime in with this exact same comment? LOL. Some things never change, right?
The manslaughter charge is the joke. It should be murder....yes, I know under current law it would fall under manslaughter which is why I think the justice system is a joke and needs changing.

You're right, some things do never change, like your bitching about things that you are clearly uneducated about.

The Canadian laws for Manslaughter and Murder need to be updated. Does anyone else remember the case from a few years ago in Edmonton, when the guy shot a gun into a crowd of people, and he was sentenced to 2 years for manslaughter because he wasn't trying to kill the girl who was actually hit, he was trying to hurt someone else.

I'd be interested to see that case as the Canadian laws are based on common law principles, and common law allows intent to transfer. So intending to hit person A and instead hitting person B doesn't change anything.

Thanks. Now read up on what you're bitching about instead of just sitting there calling things embarrassing. It's easy to bitch, it's a lot more difficult to actually discuss the issue.

Here's a breakdown of "Transferred Intent." I too would like to see that case.

My personal opinion is that it really shouldn't matter, a person firing a weapon in a crowded space is intending to take a life the moment he pulls that trigger, no matter who gets hit. The Supreme Court appears to feel differantly though

The Supreme Court only feels differently in select circumstances. As with anything like this you can't look at it as a black and white issue.

My buddy was at a bar and got dragged outside by 3 cowboys because he looked at one of their girlfriends. They beat him down and curb stomped his face breaking his orbital bone and jaw causing him brain damage and permanent scarring nearly killing him in the process. 2 of the men got community service and one got a month in jail, ever since then I've lost all faith in the justice system. Those same idiots have probably killed somebody and gotten away with it.
