Actually, failing to pay taxes is one of the ways they do get busted. I know tax lawyers who say the smartest thing they could do would be to simply declare their grow op earnings and be taxed on them.
Hopefully Colorado is just domino number one.

if the Liberals had put forth anyone actually electable in the last 10 years, it would have already been legal here. it's one of the reasons i'm hoping for some real leadership in that party for the next election, far too much money and resources are wasted prosecuting recreational drugs when they could be collecting the benefits instead

Well you may not be able to buy it freely until something changes federally, but at least you don't have to be too worried getting busted with anything under an ounce.
60 Minutes had a really good documentary about it.
Us Federal Law still considers MJ a banned substance but thus far they havent changed it so the state law is now in direct opposition to Federal law. I think they way 60 minutes put it is that Colorado did this so they could take it to the Supreme Court and challenge it as a state jurisdiction case.

Unless they are going to institute roadside blood testing the threshold will probably be:
1) Officer smells marijuana
2) One false move on the sobriety test
Couldn't they do some sort of pin-prick, like for diabetics testing their blood sugar?
I always thought Colorado was a more conservative state. This is great news though! Anyone know how that vote turned out in Washington? They were voting for the same thing and when I went to bed it was 51-49% in favor of legalization.

Colorado has become more of swing state the last few years. In the same interview I mentioned earlier the (Democratic) governor attributed it to high levels of in-migration by hispanics.

Unfortunately, since marijuana can stay in the bloodstream for up to 6 weeks it would only be proof that the person had ingested marijuana in that time period.
Which is just as easily proven by simply turning up the music and seeing if it's playing either Kid Cudi, Bob Marley or Deep Purple depending on the age of the driver.

Conservatives aren't necessarily against drugs. In areas like Colorado many of the Conservatives are "Libertarians". Libertarians are oppossed to government interference in general. A true Libertarian supports legalizing all drugs.
As for the legalization, this is nothing but a positive in my mind. It's pretty clear the "War on Drugs" is a massive failure and has criminilized entire populations.
The USA needs to follow a model like Portugal. Legalize use and small possession of all drugs. Divert the money you were spending on punishing these offences towards rehabilitation and health care. Cracking down on major trafickes makes sense. In the case of Marijuana, just eliminate their market by supplying state grown Marijuana.

States should have the right to regulate this kind of stuff.
Feds might try to fight it, but with a huge budget deficit and the unpopular drug war, who knows what happens with DEA funding. Colorado and Washington are effectively giving them the finger.
With so many different strains of marijuana with different effects out there it would be like saying that the government could eliminate the alcohol industry's market if they simply started brewing beer. It might appeal to the majority but different people have different tastes.
A market for different strains of Marijuana only really exist in places with sub-par Marijuana. In BC for instance, you can find differenet strains, but most people just sell straight out BC bud, because it is that good. Even then the average user really isn't that concerned. In fact, the only place I've ever been offered any kind of specialty Marijuana is in the USA. Even then, my friends, who are regulars (I am not), told me the stuff was not as good was what was being offered in BC.
Sure, you'll have some aficionados, but most people just want to get high. Either way you'd put a serious dent in profits having the government supply high quality and consistent Marijuana. You might have a few suppliers continue to make designer brands, but most would say it wasn't worth undertaking an illegal enterprise to supply a small segment of the population. You always have the option to increase penalties for Marijuana production if you want to further deter people.
Off topic, but we were recently in Amsterdam where we were told visitors cannot legally smoke this stuff. No, we don't so it didn't affect us. Now I'm reading that the nation is backing down on laws prohibiting visitors from using. Instead, they will leave it up to individual cities to prohibit, or permit it. Amsterdam is a very interesting city.
