Ken Jones says he will not sue Glendale in part of the Coyotes lease agreement referendum failing. Had a fallout with GWI by the sounds of it.

this was via @LisaHalverstadt yesterday.

Hocking is up on a SEC Rule 10(b)-5 charge and an A.R.S. fraud charge for false and misleading statements made in an Official Statement for a bond offering. As background, in 2005, Prescott Valley Arizona sold $35MM in revenue bonds to build a 5000 seat arena. The plaintiff in the case is Allstate Life Insurance Company and some other investors who bought the bonds relying on information in the offering documents. According to plaintiffs, the Official Statements and the disclosures within them omitted critical information, allegedly known to Hocking (and co-defendants) that rendered portions of the Official Statements false and misleading.

The case is now in extended discovery and things aren't looking very promising for TL Hocking. This is relevant to a potential Gift Clause challenge as Glendale relies heavily on the loss avoidance component. And that component is based on Hocking projections (even though the report is attributed to Pollack).

It's not good to have your defense centered on arena revenue projections when the guy providing the projections is up on securities fraud for intentionally making misleading arena revenue projections in another city.

True but it's pretty clear that there are Arena managment services being paid for here in this deal.. this isn't like Selling the parking rights back to Glendale ala the Hulsizer deal.

I think if GWI challenges on the gift clause, it would be on the grounds that the AMF far exceeds market value, and is truly a subsidy. Also, that Hocking's report seriously over-estimates the damage to Glendale if the Coyotes leave, in that other possible tenants/events were not seriously considered. Maybe apples and oranges, but they could show the arena in Kansas City is operated at a profit, without a major tenant.

I still think CalgaryPuck should collectively pony up the money, buy the Coyotes, and run the team by committee.

Vote for executive positions, and all executive proposals (hirings, signings, trades, drafts) must go through CP surveys to be approved.

I bet we come up with just as much real cash money as half the other bozos who have tried to 'buy' the team.
